GC For My Parents

All,

I live in Chicago. I am an US Citizen.

I would like to apply GC for my parents , so that they could stay with me as long as they want and visit when they want to.

Could anyone reply to this post on what are the steps that need to be taken?

Also, if anyone who have done this with Chicago, I would like to know how long would the entire process take.

Help is appreciated.
 
Hello 1wish, the GC will require your parents to maintain permanent residency in the US, which puts certain constraints on the time they would have to spend here vs. being outside the country. When you say "visit," how long would they be staying here in a typical year?

If by "visit" you mean visit the US, that is not what a GC is for, and it will eventually taken away from them if they don't actually live in the US most of the time.

But if by "visit" you mean visit your house, while they live elsewhere in the US, that is OK.
 
GC is for permanent residence, don't confuse it with a 10 year multiple entry visit visa. The cost involved and time spent in acquiring a GC is only worth if one intends to live permanently in the US. That is my opinion, but you make your own call.

I am planning to keep my parents for ever , I mean they would stay here with me for ever but whenever they like to visit India for 6 months they would visit India. That is the plan.

By staying with 10 year Visa, it would not allow them to stay here for more than 6 months.

I understand the pros and cons of GC vs 10 Year Visa. I am thinking, GC would work better.

In worst case scenario, they would shuttle between India and US frequently. For example, they would stay here in the US for 1 year then India for 6 months..and so on....

It is fairly easy compared to EB green card application, because your parents don't even need visa numbers. See this page for a brief explanation of the steps in family-based immigration, then follow instructions of individual forms which are pretty straight-forward.
 
1wish, here is a very comprehensive thread devoted to petitioning for parents. Your parents are considered your immediate relatives, so they will have a visa number immediately available to them. If they are outside the US, they would be using consular processing (CP).

Please be sure they understand the responsibilities of being a permanent resident, such as filing US income tax on their worldwide income. :eek: You can review these responsibilities in this Welcome Guide.
