Hi,

My mother is currently in India. Her 10 year visa will be expiring in June, 2012.

We are planning to bring her to the US in April/May and apply for GC. Do you think she would be granted a 6 month stay at the Port of Entry, given that her visa itself is expiring in June?

Also, can the GC process be completed within 6 months, assuming we apply soon after she arrives in the US?

Is this a good plan or should we be applying for the extension of the 10 yr visa? Also, given the situation, is AOS or CP better?

She should not enter the US with a tourist visa while having the intent to stay and file for AOS. If the interviewer knows her plans she'll get refused entry. She could be refused entry just for having an adult US citizen son or daughter.

If you file the I-130 now with CP, she'll probably get a consular interview sometime in the Summer or Fall of 2012. Once approved at the consulate, she would instantly become a permanent resident upon entering the US with the immigrant visa.

Start CP in india. by july 2012 she shold be done with the processing. It is better to go through CP.
She can come to USA and apply for AOS, after 90 day of her entery, That is only optional.

I want to know what AOS and CP?

I am currently in the process of my citizenship. I expect to get it by Apr/May this year. My mother is having 10 years visitor visa. So, I am planning to call her just before I get my citizenship and then plan to apply her GC while she is here. I have been told by many people that if I file her GC while she is here on tourist visa, she will not have to go back.

Can somebody confirm this please?
