It takes one year for 140 amendment to get approved??? That sucks!!

What if 140 amendment is not approved or a person loses a job while it is pending? Can he/she use AC21 if 485 is pending for 21 months since orginal 140 was approved? Your thoughts???

I don't know whether you can use AC 21 or not..

Talk to good attorney like Murthy..

Its worthing consulting different lawyers before trying to use AC 21 ... Thats my personnel opinion from my experience


Read our stories in the above thread .. put yourself in that situation and ask your lawyers how they will handle in case if you use AC 21..

Thank you Anamica for your swift response. My 140 amendment is pending since Feb 03/EB3/NSC. No news yet.

Murthy said that it was OK.

You could file for H1 and start working but do not need to leave country to stamp. Doing that could be disastrous as reentry could be difficult.

You need to have valid EAD if you have exhausted H years.
