Gurus,

I have an employer who is willing to file for my Green card (Labor + 140 + 485) application as a future perspective employee.

Do I have to join this company at some stage during the application process? Can I file for labor, get labor approved, file for I-140 and 485 concurrently and get my green card and EAD without working for this company during the processing stage? I am working for a different company but want to start my GC process with this company for surety purposes.

Thank you.

--- YES
and get my green card and EAD without working for this company during the processing stage?
---- You will get EAD and AP after till that time you can work with other employers but after I-485 approval have to join him or have to USE AC21 before I-485 is approved and you can fulfill the criteria of AC21

--- File LC immediately

Thanks Ginnu.

At what stage would I have to join this company though and for how long?

1. Labor approved, I-140 and I-485 pending, but I get the EAD, can I join this company on EAD and work there for 6 months and I-140 approval before I can use AC-21?

2. Labor approved, I-140 approved, I-485 pending, can I join this company on EAD and work for 6 months before using AC-21?

3. Labor approved, I-140 approved and I-485 approved, it might take long time, but lets say everything is approved, and I havent yet worked for this company that sponsored my GC, do I have to work for this employer in this scenario? If so, for how many months? Can someone get his Green Card through company X and never work for that company?

What happens in situation when you never work for the sponsoring employer? I'm curious about this situation as it could open a can of worms? Is this a AC21 situation or would it be a problem during citizenship?
