Future Employment Questions

I have filed my GC with a consulting firm for future employment and I am currently working for a different company. My labor was approved in 2004 and I-140 was approved in August 2005. I am currently waiting for my I-485 approval which was filed concurrently with I-140 in April 2004.

1) Am I obligated to work for the sponsoring company prior to my I-485 approval?

1.a) If yes, can I work for them for 6 months and with AC 21 permanent portability, can I switch to the current company I am working.

1.b)If not mandatory, should I just apply for AC 21 portability and just continue working for my current company.


2)Can I just work for sponsoring company after my I-485 approval?

3) If I switch to EAD from H1B, can I work for both employers?

What would be your recommendation?

I am also in similar situation but still I have not filed for 485 because of retrogression dates.

I have an approved I-140 with a future Employer (EB2 && PD: May 10 2005). Recently an old EB3 labor with PD: Mar 31 2003 has been approved with my present employer. I am due for 8th year extension with my company on October 16 2006.

I am in dilemma whether to file I-140 with my present employer and go for 8th extension OR to trasfer H1-B to Future Employer for getting
3 year extension. I do not know which priority dates (EB3 vs. EB2) are going to move first for filing I-485.
