Future employment after GC. Approved?

I just got my GC Approved for future employment,

Here are my concerns


1. Do I need to join this future employer that filled for my GC?
2. Can I just run the pay roll with out joining this company if so for how many months I need to run the pay roll?
3. If I don’t Join this future employer that filled for my GC what are the consequences?
 
Very interesting question. Why do you think this is a 'future' employment? All cases I have seen so far (of employment based immigration), they have got a labor+140 for the same job they are working on now.

Can you elaborate what you mean by "Future Employment"?

If you are in a same or similar job, then you can continue with the current employer under AC21.

If the employer kicks up a stink, I suppose he could claim fraud, but since the adjustment took four years I doubt that would get very far.

Can you please advice please


485 Approval letter
I got letter from USCIS local office that my 485 application has been approved.
and told to check the address.

But in the letter it says"
You should received your Permanent resident card somewhere between six and twelve months.In the event that you move,be sure to advice USCIS of your changed of address referencing the above "A" number in your letter.

I was wondering why it will take 6 months to 12 months to get the card.

I did not get a letter about coming to local office and get GC stamp in my passport.

Please advice.

I just filed i-485. My pD is Jan 2004
i-140 has been previoulsy approved.
Now my original employer agreed to give me evl, but with the way the economy is going they are not doing well.
I have another employer which I am working now with.
How likely is to get an approval (or an rfe for paystubs?) before 180 days.
I am eb3 row
Thanks, I am very depressed it took too long I guess and the economy changed and now the whole future of my family is pending

I am working now on a similar job description as GC approval description and the company that filed GC is fexible.

I am in the same situations. My GC was also filed and approved for future employment but I never worked for them. My I485 was pending for two & half years. Details are in the signature. I also confused whether I should join GC employer or stay with current one. Job duties and salary is same.

I did consult a lawyer, he suggested I need not work if it is ok with the employee.

The company that sponsor you have a right to revoke the greencard if you did not join the company after you've got approved.

You're required to stay within the company that sponsor your greencard at least 6 month after the greencard approved.

there is a different when you already join the company and within 6 month after your submit your I485 application you might move to other company with similar job description.

But again it's all depend on the company it self. If they ok you're not joint them and they are not going to revoke the greencard you are OK but not many company willing to do that.

My lawyer also said since it was pending far more than 180 days I am okay. In my case my current employer is a subsidary of my sponsering employer.

I was with company X, got Labor and I-140 approved, switched to company Y. As dates have become current , i want to join company X again,so that i apply for I-485.But company X has already informed USCIS that i no more work for them. Can I still file I-485 ,as future emplyement for company X, and give paystubs of Company Y to show my valid status ? Do you see any problem ? Please please please reply !!
 
I don’t see any problem with that!

As GC is for future employment it shouldn’t be a problem filing for your I485 even though your h1 is revoked by company X and you need not join company X if its not required and file your I485 as future employment basis so once your I485 is in the final stages you can join company X using your EAD . Just make sure that when there is an RFQ they support you with future employment letter.
