Hi, I've already done my finger print about 2 months ago for my I-485. I was told by my boss that my job status might change from full time to part time position in the next couple of months.
1) Will this impact my green card decision?
2) Can I get another part time job some where else and if I can, does it has to be similar to the job that I file with the INS?
3) What is 180 days rule?

Thanks very much.

1. Should not affect. Since GC is for the future job
2. yes You can get any other job, as long as you are using EAD for both jobs and one of the job is what is described in LC/140
3. That you can change employer if 485 has been pending unadjudicated for more than 180 days and you change to a similar job (title, job responsibilities and salary attributes' comparisons determine similarity- in that order)

However, the job that is sponsoring the GC must be full time and you must work in a full time position when the GC is approved. Also, the company's failure to employ you full time raises questions regarding their ability to pay the offered wage.

Thanks for the reply. Can I stay part time with the company that sponser my GC until my I-485 get approved? or do I need to find a new full time job?

Thanks again.

U can remain PT until GC approval. But if INS questions your employer's ability to pay for a FT position, a letter from employer might not convince INS.

Full time to part time (Cont. 2)

Thanks Jaxen and Mr. Mills for the answers. So, what should I do to avoid the problem? Does the INS interview everyone who apply for file the AOS? If you have any good suggestions that you think might benefit me, please let me know. It'd be greatly appreciated! :) By the way are you an atterney?

Thanks again!

My suggestion would be to try to find a similar full time position ASAP if the employer converts you to full time. INS does not interview everyone but if they do, or if anyone ever complains or if you attempt to naturalize, INS may discover this mistake and your GC could be cancelled.

Yes, I am an attorney.

Full time to part time (Cont. 3)

Thanks again. I've talked to a friend of mine at work and he just give me a thought. If I go to part time with my current company and I get another part time job some where else. Can this two be considered as a full time. Since the economic in US isnot as good as before. Every day you hear about laying off. Will this posible?

Thanks again.

Using EAD, being on H1B... Is it possible?

Jim & Jaxen,
I have a question on this topic! My H1 is valid through 2004 and my I-485 is still pending(I think, it is too close to be approved!). My question is... Can I go on vacation for the current employer (being on H1 and GC is being processed on H1)and work for a different employer on EAD? OR should I be working on EAD at both of the places! The other employer is saying that is fine, but my gut-feel is 'not necessarily true'! I will take your word! Please try to give your word by 10/11 am Friday morning! Really appreciate both of your help!

Thanking you in advance!!

FUll time to part time

If I have to look for another full time job, can it be any where in the US or it has to be around where I live? Also, let say If I teach electronics, is it ok if I find another full time job as a drafting teacher? (I've study both electronics and drafting in college.)

Thanks again.:)
