from h1b to EAD ...help

my h1b is expiring in few months. i have EAD.

my question is, does changing status from h1b to EAD needs any documentation from employee and employer side ?

i am worried about the h1b extension as my client doesnt provide end client letter and therefore i think, its better to use EAD instead of h1b extension filing.
what you guys think?
 
To use the EAD all you have to do is fill out a new I-9 (when your H1B is about to expire or has just expired) with your employer and show your employer the EAD. There is nothing to file with USCIS. Repeat when the EAD expires.

so... what you r saying is, I-9 is just a application with employer and it just sits with employer ?

i Have another question, if i file for h1b extension few weeks before my h1b expiry and continue to work on h1 status using the receipt till decision of h1b. now lets say, h1b gets denied (after few months of h1b expiry). in such case, will my status still be ok....since i have EAD even though i was working on h1b even after h1b expiry using the recipt # till the decision ?

It sits with the employer, but from time to time the immigration authorities will audit the immigration files of employers.

Yes, you'll be OK, as you still maintained employment authorization throughout.
 
Since i-94 expires with h1b expiry (as both have same date). my question is, can we simply switch to EAD even with expired I-94 ? i mean there is no need to go out of US and come on AP ?
