From Asylum To Citizenship

Situation seems to be confused and less important to us since he applied on the basis of being spouse of a US citizen.

Wanted to also let everyone know: my mother who received asylum years ago had just applied for citizenship and had her interview. No mention of anything related to asylum in her interview. She, however, did not travel back to COP or applied to renew her passport. She traveled outside the US (not to COP) using RTD. The officer was more interested in her receiving social benefits (e.g. welfare) as opposed to anything having to do with her asylum...

Yes i went back to my home country but for emergency reasons/my dad was sick also the political conditions in my country had positively changed.

Yes i used my passport that i renewed at our embassy in Washington DC.

I have similar situation like yours. I need to go back to COP this year because my dad and aunt are very sick. Do you know if I can use my NP from COP to enter COP? Will I still need Travel Document? What kind of supporting document/evidence to prove that I really need to see my sick aunt and dad? Is there any maximum length? I heard it's dangerous to show GC/TD to COP, is that right? I'm married to a citizen last month, got my GC October 2005, do you know when I will be eligible for a citizenship?....I apologize about lots of questions, hopefully I won't be confious anymore by your generosity for answering my question..take care..and congratulation for your US Citizenship..

Am sorry to hear about your Dad and Aunt,I never could use the RTD.
I had my passport renewed at home country`embassy in Washington.

Petitioned FMLA from my job at the time.

As soon as i got to my COP i obtained the detailed information of my dad from the hospital he was at,also got the info of the doctor who was in charge.

faxed all that info to my job as a requirement.That was the same info i was going to use in case questions arose during my citizenship interview.

The company i worked for contacted the hospital in my COP and talked to the doctor several times,that was pretty good evidence for me just in case.


As for how long you can stay, I believe you have to abide by the rules that govern GC holders.

You will be eligible for citizenship 3 years after the date you were granted PR as well as 3 yrs in your marriage.

Did you mean we are eligible for citizenship after 3 years granted asylum or does it only apply to those individuals that were married to a US citizen?

For Asylees it is 4 years after getting their application approved since the 'Resident Since' date is backdated 1 year from the approval date.

For individuals married to a US Citizen it is 3 years - provided that they applicant has been a PR for those 3 years while their spouse was also a US Citizen for those 3 years.

In either case, applicants are allowed to apply 90 days in advance.

Does that mean that I need to use RTD when I'm at the airport US Immigration, leaving for COP, then when I enter my COP, I use my NP at the airport Immigration and the same thing when I leave COP and re-enter US?

I called 1-800 number INS, they said I have 5 years until I can apply for citizenship. My 'Residence since' is October 2005, and they said in year of 2010 I can apply for Citizenship. So, I should count start on October 2004 instead of October 2005?

I appreciate your respond. Means million to me since even some lawyer can't answer those sometimes.
 
Sessanga, thanks for sharing your experience with us. I am in a similar situation and would really appreciate it if you give me more information regarding the process. I got my green card based on my political asylum status. My green card was approved in May, 2006, and it is backdated to 2005. I am married to a US citizen man before I got my green card and I would like to apply my citizenship based on my husband status. My question then to you, did you do your application yourself? Or did you hire a lawyer? What form did you fill out? What kind of information did you need in order to apply your form? And one more question, did you submitted your application after 3 years or 90 days before? I am sorry for asking you too many questions, but I could not help it. I am kind confused on what to do which is why I am bugging you here :) . Could you please give me more information about this?

I got my green card based on asylum case in May 2006 but it is backdated to 2005. I have being married to US citizen man. I would like to apply for citizenship. From my I understanding I can do that on May 2008. But someone is telling me that I can send my application 90 days before the 3 years date. Is that true?

Also, what form do I feel out? Do I need to have a lawyer? Is there a place where I can find information regarding people that apply citizenship based on marriage after they got their green card through asylum.

Hi, my mother applied for US Citizenship based on marriage to a US citizen but having gotten her green card through adjustment of status from that of an asylee. You need to be sure that all three conditions are met before you apply based on marriage:
-your spouse must have been a US citizen for three or more years on the date you apply.
-you have been a permanent resident for 2 years and 9 months on the date you apply.
-you have been married to and living with your spouse for 3 or more years on the date you apply.

If you meet these conditions, you can apply for US Citizenship using form N-400.
 
WOW, good news for me then, i have been married to a US citizen for almost 5 years now and according to what vdostoi1 is saying i will be eligible to apply for citizenship in 2 years and 9 months?? and that's counting from the date i received the card or one year earlier?

Oh well - I suppose the IO will have to be satisfied with an explanation and my Re-Entry Permit in lieu of a national passport.

Thank you for your respond. I appreciate it. With the exception of 2 years and 9 month, I do meet the other condition that you put in here. So now it is a mater of time, I will wait and apply in a few months. By the way, did your mom hire a lawyer? Is it even necessary to do that? I was going to do it myself but have not make a decision yet. Any information on this will be greatly appreciated it. Thanks
 
Me personally i did not hire any attorney to file my N-400,i did it all by myself since i did not have any legal implications.
