Fresh H1 applying

Hi, How much is the lawyer fee, educational documents evaluation and INS petition fee for fresh H1 applying. Do I have to pay this all?

For premium processing, I know it can take upto 20-25 days to get H1 approval but not the passport stamped but I want to know how much total time it will take from filing the H1 case to getting passport stamped? For salary, is it determined by the employer or by INS.

What are the necessary and important things I should to consider and ask from the employer before sending documents to the employer who will file my case.

--- you are confused about H1 petition approved by USCIS and VIsa stamp, once employer submits the H1 petition it goes to USCIS and I dont know where your employer is going to apply if he files with premium processing then he may get H1 approval petition in 20-25 days, if he apply normal processing then H1 cap may hit in few days and wait for nest year. Once you get H1 approval petition from your employer that he got from USCIS then you need to visit US consulate for the Visa stamp and it depends on consulate how much time they will take( I dont know where you will apply H1 Visa stamp)
For salary, is it determined by the employer or by INS.
---- Employer has to get LCA from DOL and have to pay minimum as on approved LCA it is decided by DOL and employer not by INS( INS is no more now it is USCIS)

----- does he has job? when he will start the pay? how much is he going to pay, check the record of company from friends or post the name of company and location in US others may guide you

do you really think the cap might be reached if the application is now filed under normal processing? as per their report on august 18, they have only received 46,000 applications countable against FY 2005 cap.

isn't the cap counted by the date of receipt of applications or is it counted by the approvals so far? when will INS stop accepting new applications or do they actually stop? Do the applications filed after cap is reached automatically roll over for next fiscal year or does the employer have to submit the applications again?

--- I am not expert only USCIS knows how many H1 they recieve till your application reaches USCIS. I will file through Premium processing so that I get the results in 20-25 days
