----- you are eligible for EAD,AP . I-485 will only be approved once they have visa available from DOS for Oct 2002 and no one can say when the visa for EB3 october 2002 will be available.keep on extending H1 and dont use EAD if your I-140 is not approved(to be safe)
PLEASE ADVICE!!!

Just a reminder, ginnu, he said his I-485 was filed in Oct 2002. The retrogression may affect him if his LC was filed in 2002, but based on that I-485 filing date, I somehow doubt that is the case.

What's the LC filing date?

--Thanks TheRealCanadian, You are correct ,we dont know when his LC was filed.

LC date in 2001

LC was filed in 2001....
But am worried 'cause in murthy.com...it says that even the approval of GC will have to be based on the priority date..is that true????

doe,

what are you worried about. You are in the safe zone (your LC priority date falls before the retrogression date). Your process will continue.

I485 approval= GC approval.

Saw on murthy.com site

I am worried 'cause I saw this on murthy.com

"This means that, as of January 1, 2005, anyone who is the beneficiary of a labor certification (or I-140 if a labor certification was not required) in the EB3 category filed on or after January 1, 2002, will not be permitted to file the I-485 or have a consular interview for an immigrant visa until the numbers move beyond this date"

That even approval has to wait...:(
