Hi Guys,

Sorry to harp on the same old tune but I am on h1B (never stamped on my passport and I have 4 years to go on that). About to get AP and travel to my country (Pakistan) after 3 years on AP. No I know that most people on this forum say that you can use AP to go out and come back and still work on H1 with the same employer without any issues, correct?

They refer to a memo from INS published around 1999/2000. My question is whether that memo (that allows for dual intent) is still valid as I read in some other places that a new memo from USCIS which came out in 2003 has basically made this earlier memo invalid. Can someone please help me on this? I dont want to take stupid risks.

That's correct; it is the Cronin Memoranum and has not been superceded, to my knowledge.
