For Concurrent filling of I –140 / I-485...in Feb, March , April, May 2005

due to retrogation there is number of cases filed in september end, so there may be delay in 140 approvals.

Any comments.............
any approvals in October..........??

That’s really sad, after taking big money these companies exploit us. You have only two options
(i) Talk to you company and ask then about the number and take them in confidence that you will not leave the company.
(ii) You can call the customer service center of Nebraska and request them that if they can give you I-140 number.

Ya if message change after biometrics thats the best thing. But if not nothing much to worry at this stage (50 days after biometrics). Still you have some more time to worry about I-485.

Finished Biometrics(FP+photo) 50 days back. LUD changes on 485(mine&spouse) on the next day of biometrics but there is no change in message.Will the message be updated after FP?

Congrats for I-140. That’s something strange. But it happens some time. You can call the Nebraska Service center and tell them to update you status.

not to worry about that.....I am also having the same issue......just get a copy of the 140 approval from ur attorney / employer..... and pray for 485

u shd be fine......

What does it mean-- Is there any progress or ....

I am also sailing in the same boat.
Filed for I140,I485 EB3 Category on June 22nd 2005.
Fingerprinting 18th Aug.
EAD received on 22nd Aug.
LUD date for I485 is 20th Aug.
I see the processing dates in immirration.com for I140 are in June 2004.

I140 not approved

Hi All,
I get to see that everyone have got their I140 approved within a month or two.
I have received the EAD/AP, fingerprinting notice in August but, my I140 is not approved.
Here are my deatils

EB2.
Filed I140/I485------June 22nd 2005.
EAD approved ------Aug 15th 2005
AP approved-----------------Aug 28th 2005
Fingerprinting notice-------Aug 26th 2005
The LUD for I485 is shown as 28th Aug.
But, my I140 is not approved.
Has anyone filed at the same time and got the I140 approved?

I got my fingerprinting notice in August but, havent got my I140 approved yet.
Can u tell me if I140 gets approved first or fingerprinting notice comes first.

In my case 140 came before FP

RFE = Request For Information
AD = Arrival Date

I think Usually 140 comes before FingerPrint notice but have seen FP coming first also. In my case 140 came first.

Hmm. No change at all in the bulletin. Was hoping for a movement by few months. Hoping that happens this month since Dec is generally is washout.

Guys: This update is quite unfortunate for me it seems. Have not been able to talk to my laywer but my HR rep did. Now she has no idea what he told her..went over her head. I think what she gathered is that USCIS is telling my lawyer to convert the case from EB2 to EB3. Not sure why

Here is my Q. Will they expect us to re-file or do they just convert from EB2 to EB3? We barely made the dates to file concurrently. If they ask us to re-file, me and my wife shall not be able to get benefits of EAD/AP and that would be such an unfortunate thing. I shall talk to the lawyer on Thursday where he is going to explain things to me.

Until then I am worried...will I have to re-file and loose 485 benefits? Or does USCIS simply convert EB2 to EB3?

To add salt to the wounds, just got an email from USCIS that my EAD has been approved and cards shall be mailed out soon, when ready. If my EB2 is not converted to EB3 and 485 needs to be refiled..it would be quite unfortunate..having received cards which are useless! :(

Does anyone have any info on above?

I wanted to know if I am looking at the correct category.What classification do the people who filed in EB2 category come under.
Any help is highly appreciated.

You should look for "Advance Degree or Excp. Ability" and you are correct as of 10/15/2005 the processing date for this catagory is 09/01/2005.
