FOIA Success - Labor file received from DOL

Let me summarize: You can get the LC information from 2 sources: (a) DOL (b) USCIS Service Center.

DOL
Positives: Takes less time (3-4 weeks), can talk with a person, no forms to fill
Negatives: Get LC papers filed only (they have all the info regarding job code/salary/desc) - not the actual certified LC and 140.

USCIS
Positives: Get all docs, including the certified LC and 140 approval copies
Negatives: Takes upto 3 months

Getting file from VSC.. It is easy !

I send FOIA request to VSC to send all my file as I do not have copies. For the specific "Please send me entire papers of I-485 file including I-140, labor etc. as I do not have personal copy with me." AFter that I got letter saying that they will send asap with control number. on 85th day I got total file with contain entire stuff more than 100 pages. More over it is free of cost. Only pain is it takes around 3 months. Hope this information help people who has problem of getting LC, I-140 approrals copies.

Thanks for all the valuable information provided by you. Can you share the telephone number of the FOIA officer. I need to get the LC information from Chicago DOL as well. Is it possible for you to give me the address to which you sent the request letter ?

FOIA - LC

Today I called NY DOL 518-457-274. she told me send fax with your requirement. we will find out what you want and send you in mail.

My question : Is there any way my company will know. or they will contact my company and ask them why I am asking again LC document.

My I 140 is applied by my company. they do not want to apply I 485 until I140 approve.

Anybody have correct information for NY DOL FOIA. Please send me email on akp_158@yahoo.com.

The DOL takes FOIA requests by fax and mail, so you probably have reached the right person. Make sure you mention FOIA in the fax u send - a sample letter is attached at the start of this thread.

I don't believe they inform your company.

Which DOL to call

I also want to get papers from DOL. I want to know which office the request should be sent. Say my regional labor filed in LA and federal level labor in Texas and I am in working at CA. Which DOL I should send my request i.e. LA, TX or CA ?

Does VSC send a letter saying they received our FOIA request?

Also, how long do they take to process FOIA request.

Is there priority date for FOIA request also which is available in some INS website??
 
If you file FOIA with any service center, they send you a letter with a tracking # for ur FOIA request case.

It takes 2-3 months for them to get the complete file to you.

In how many days do they send the tracking no?
Is there a website for tracking also?

hi, can you please provide me the phone number and the name of the officer I need to speak with. I called the DOl regional office in chicago and someone I spoke with said that she cannot even talk to me about the application or release of records.
Please advise.
