Hi all,

I would appreciate any advice on my situation.
I have changed to H1B from B1 3 years, still on H1B and been
here in status all the time. The only thing is that I got rejected H1b stamping in Canada 2 years ago, but was able to return without visa stamp, INS officer at the border did not seem to care about it at the time, since I had valid H1b status and approval notice with me.
Now I want to go to my home country and try to have visa stamped, do you guys think it could be be problematic?
I also started gc with the company, not sure how consulate
back home will like that...

Thanks, any advice is greatly appreciated!

Ann

P.S. I'm a software engineer if it helps to know.

It is definitely a risk. If the rejection by the canadian consulate was inability to evaluate your non US degree and you have a genuine degree, then most probably you will not have a problem at home country consulate.

What's the status of your GC? If you can wait, you should. Again depends which country you are from? Situation is worse in some compared to others right now.

Thanks everyone for your response!

Yes, Canadian consulate gave reason for rejecting as
inability to evaluate whether my credentials are
satisfactory for the job. I do have BS in computer science,
from my home country, which is Armenia. Not sure
how strict is consulate there though....
did anyone had similar experience with Armenian
consulates?

Thanks!

Don't know about consulate in Armenia but definetely get your degree evaluated from some good co. in US beforey yuu go back and apply.

U should be fine. Maybe U can ask your lawyer to do a search on the credentials for H1B visa holders from armenia, in case you suspect US consulate in armenia rejects h1 applicatns routinely. Otherwise you should not face any problem just because US consualte in canada refused H1 stamping citing degree from a Non US country...
