recently my cosin had two meetings with two different but the best attorneys in san francisco.matter is...can we file lawsuit to get citizenship right away instead of waiting 3 more years..?..those attorneys said ..sure ! you can.based on ..when we filled i-485 back in 2000; INS send us a reciept saying it's would take between 365-565 days.but they couldn't get job done.if they were short of labour or whatever ;it's their fault not to keeping their word.second, CIS consider us permanenet resident since the date of our asylum grant.that's why they give us credit of one year because we file one year after asylum grant.
now question is...one of attorney asking for $15000 and another is $5000.
but no gurentee.
do you guys think it's worth to take the risk..?

you right :delays in getting P.residency mean delays in getting citizenship.
but the question is how long the lawsuit gonna take?

It does not matter how log it would take. We can set the legacy for those behind us. Bottom line is refugees get their GC faster and backdated to the day they enter the US, why not us?

We can always ask the AILF as they are now experts on the INS suits!

Of course the time matters and I agree with Jubilee. The time the lawsuit get approved, some folks will be citizens and some other PRs and nobody is gonna take advantage of that even those behind us since we see some RDs 2005 getting approved and uscis promessed to bring the waiting time down to six months by the end of 2006.Those behind us will be getting their GCs fast and this lawsuit is not gonna make any difference for them. The lawsuit should be good for us who wasted 4,5 or 6years to get GCs.But as I said,by the time,we all will be reaching the citizenshipand that will be too late.

RD Aug 22,2001
Approved Sep 15,2005
GC received Sep 20,2005

there are never any guarantees in lawsuit. And the very attorney who is assuring you that you should file a suit, looses suits every day. I think you should talk to AILA attorneys. They definitely must have considered it already. And it would be worthwhile to know why they havent' filed such a suit yet!!!!!

Good idea but I dont think you will win it. The asylee vlawsuit was because Govt didn't give out visas(gc's) as required by the law. There is no where written in the Immigration law that a GC should be processed in 500 days or whatever. If there was a law that said, a properly filed application should be processed witthin 500 days..then you have a base for a lawsuit.
