Filing I-130 with consulate with special circumstances

Hi everyone,
I hope i am doing the right thing here and hope someone can give me advice.

I am a US citizen. I have been in Holland for almost 3 years in a relationship. Last month we were married. We need to relocate to the US in order to help my family. My father was diagnosed with Lung cancer last year but the surgery to remove it was unsuccessful. After treatment the cancer is stable and has not spread or grown (thats the good news). My father finds he can no longer run his business without being worn out. He has asked my husband to come and help him. I looked online and saw the wait time for a VISA is 5 months. For me that is too long, im not sure how long the cancer will remain the same and how long he will be able to teach my husband what he needs to know. So, in my research i have found there are special circumstances where you can file through the consulate, im not sure if its faster but im thinking it is.
I sent them an e-mail last month about my circumstances and they called me the same day. they need more information on everything. OK after a month of waiting i get a letter from the doctor that my dad has cancer and i get a letter from my dad saying he needs help with his business. That i e-mailed yesterday to the consulate.

I guess my question is: was that the best route? Is there a faster way to do everything? Does anyone know how long it takes for this? I have spoken to an attorney but he says if i file direct with the consulate they cannot help me with it so i know im on my own here. I guess im getting a little nervous that i wont do it right and have to wait longer.

Any advice is helpful

You're not going to see anything significantly faster than 3 or 4 months. Indeed the 5 months is optimistic.

Be prepared to jump through hoops and you have to gather your evidence faster. They called you in a day and then it took you a MONTH to respond. You have NOTHING to complain about so far as I can see.

Have you gathered ALL the other evidence as to: the bona fides of the relationship, income issues, evidence of the end of any prior marriages for either of you, YOUR citizenship, his ID documents, Police Clearance letters or whatever they do at that Consulate which you are already dealing with? Have ALL the required forms been filled out? Has he gotten his medical exam in order?

All you mentioned was a letter from a Doctor and another from your own father and it a month!

At this point in time all they have asked for is more information over my fathers condition and his business. All other information that is pertinant to the I-130 itself is ready and waiting to be filed. I am only waiting to find out if i can file directly with the embassy since there is no USCIS office in the Netherlands. As for it taking me a month to respond i have sent 2 e-mails in the time that i had the business related papers but was still waiting for the letter from the doctor as i have no control over his schedule and when he has time to type something out.

My questions are: is the embassy filing better than filing direct with the Chicago lockbox and then expiditing?
Is this my best option? Is there a faster way to file than going this route?

Thanks for any information,
T Kuilderd

P.S. when i talked to the Consulated office and told her i had all these forms she said not to worry about the forms until i know what they are going to ask for. At this point i think i have every form filled out that they will ask for and some they wont ask for.

Trust me many people want their petitions approved yesterday and so the immigration/consular officers have heard it all. Make sure your documents are set. The problem you're facing is that it is not a case where the sick person is the one being petitioned, you're petitioning your husband to come and help your sick father so it is a case of financial loss which might not be viewed as pressing as if it were your husband who were ill and ur trying to get him her quickly for treatment.

Indeed in your case, some would have come on a visitors visa and then filed for an adjustment of status a few months after arrival. Kudos on trying to do things the right way.

Good luck.
