filing GC from future employer

Hello,

I have a question, i am employed with company A and filed for GC from Company B. I recd my EAd(and also 180 days passed on I485) and now some people are suggesting me to join the Company A on EAD but i don't want to do that and still wants to continue with company B till i get my green card, Can I do that? will there be any problem?

Please present the facts clearly to enable folks to help you with that. I don't understand what you're saying.
 
If you change the "A" to "B" and vice-versa on the second sentence then it makes sense.
You do not have to join company B on your EAD to get the green card. Green Card is for future employment so you should be OK.
It will be a good thing to be with company B if you have an interview or get an RFE, but it is certainly not required...

Company A - Working
Company B -Filed GC card.

Stage: recd. EAD and passed 7 months.

Question: Do I have to join company B on EAD or just continue with company A. Will there be any problem in case of Interview?

Let me get this straight, it's now 7 months since you filed your 485 through Company B with whom you've worked in the past. You have an EAD and are now working for Company A. Since it's more than 180 days since you filed your 485 you can continue working with Company A as long as your job description is similar to your previous one (through Company B). You can take advantage of AC21. Are you working for Company A on an EAD or an H1? Either way, it doesn't matter. So, no, you don't need to go back to Company B. In case of RFE or Interview you could just present the employment letter and pay-stubs from Company A.

If Company B is a future employer and if you have filed your GC through them, then YES, you would need to join them after receiving your GC approval. Not doing so might raise issues when you apply for citizenship. Hope that helps.

If 180 days pass since your 485 RD, you have the option of staying with the current company. In case of a RFE, present the current company's job letter and paystubs. If GC is approved with no RFE or Transfer, then .... thats even better!

GC from future employer

Hi,
I am also in the similar situation. I am working with company A for a long time. Company B has applied for my GC as prospective employer (Future employer). I have never worked for company B.
My I-485 is pending with VSC since May, 2002. B is not able to get me a project yet.
What are my options? I know, that I can get GC from B while still working with A.
My question is, when I have to join B? Since I have completed more than 10 months after filing I-485, can I continue with A, even after getting GC? Can I use AC-21, if I get another offer from company C? :confused:
Any input/suggestions are highly appreciated?

Has anyone been approved so far based on the future employment?

I wanted to find out if there are cases that has been reported where GC has been approved based on future employement - meaning the person has never worked for the sponsoring company through out the time the GC was processed and the case was approved.
