Hello all,
My case is little complicated.
I came here in 1997 in F1 visa from Nepal.
I went out of status since 2002. I got married with US citizen in 2004 after 1 year of dating. We have 4 yrs old daughter as well. I was not sure if we wanted to stay here or not but we decided to go ahead and process for GC. Keep in mind that I have been working illegally for about 5 yrs now.
I filed it on December 22 of 2009.
I had my fingerprints done on Feb of 2010.
They sent me letter for birth certificate which I didn't have at the time of filing but I was able to make one from Nepal and submitted it and the case resumed.
I got my EAD card on March 18 and I just received a letter for interview for May 18th.
I am just nervous because my case is not strong.
Any input will be appreciated about how my case can swing.

How is your case not strong? You have a 4 year old daughter together, that's quite significant. Are you worried that your ability to proof your marriage is legit isn't that great? The rest of your history isn't particularly complicated. You overstayed and got married, it happens all the time. If your marriage is real and you can prove it sufficiently, you should be fine.
 
Marriage is legit and we can prove that easily. But, I was just worried about overstaying and working illegally.

I really wouldn't be too worried. Past overstays and illegal work are generally forgiven during AOS to an immediate relative -- it really happens all the time. You just need to concentrate on bringing plenty and sufficient proof to your interview, the most significant and important being your daughter. If you can prove that easily, you'll be fine.
 
Yeah, we have both mother and daughter passport and birth certificate. We had them made up just in case of adverse situation.

Okay, My interview is on May 18th. On the interview letter, it says that bring copy of all the documents or they might keep my original for the record.
I made certified copy of Marriage certificate and I really don't have copy of anything else. I just wanted to make sure If I have to make copy of our birth certificate, ssn, driver license and other vital record? And, do I have to make certified copy of all the documents or just simple copy will work?
 
Regular copies will work. You will show them the original so they can see it's genuine, and then hand over the copies for them to keep.
 
one more question!!

I am still working illegally. I got my EAD card on March but I haven't been able to find new JOB. I am very embarrass to tell my employee about my status as well. I rather quit and not work if needed.
So, my question is, does it make difference on interview if I am still working illegally (using my own SSN but working as citizen) or do I need to resubmit my I-9 with work permit number? Like I said, I prefer to quit than re-submitting I-9.

You claimed to be a citizen on your I-9? That's a whole 'nother ball of wax; it is a deportable offense. Claiming to be a citizen for employment is much worse than just unauthorized employment.
 
Yes, I claimed as citizen on I-9. Now, will this affect my interview? Do you guys suggest that I quit job before the interview date or it doesn't matter now. I heard interview is pretty much to verify bonafide marriage relationship but you never know. I can not correct the situation anymore 'coz it's too late but I can still quit the job if that helps.

I was just confused, if it's already too late, why are they even interviewing me?

Keep us updated Lightcz! I just started the process and probably can't give much advice... But I do think you have a strong case.
I'm probably overstaying F1 visa too. I'd be interested to see how your interview goes.

Sure, I will buddy. I can't wait for this to be over. Just 2 more days left for interview now.

My interview was at 10:15. We got there around 9:45 and they called us in as soon as we got there. Only the question they really asked us was how did we meet? and just re-verified information, like name, address, work and stuff. She just looked at my daughter and said that she looks like more of me and that's it. I had all my paper organized and ready to hand her. She didn't even ask to see original birth certificate, marriage certificate nothing except driver license and passport.
We were out of there by 10:10 AM
She didn't stamp my passport though. I though they did that for others. She said congratulation and I should receive card in 2-4 weeks.

Big congrats - that's wonderful!!! I'm almost in the same situation as yours, except we don't have a child yet - so my case is probably not as strong. I think you met a nice interviewer too.
Do you mind if I send you private message in the future if I have question? I just started the process and am very nervous.
