Hi,
I filed for I-140 , I-485 and EAD on June 23rd 2003, got a receipt date from INS for July 7th 2003. I am waiting for my EAD number. THe receipt says, I will get the EAD number in 80 days from the receipt date. Here are my questions:

1. Can I try for the EAD number from the local INS office now? If yes, what documents do I need to take?

2. Once I get the EAD number, can I switch to another employer?

3. If I switch the job to another employer now, what are the potential problems? What kind of inquiry will INS come up with to my Employer.

4. If my Employer is willing to continue my GC processing, even if I switch to another employer, is it easy for my current employer to handle the questions from INS?

Thanks

Hi,
I filed for I-140, I-485 and EAD on June 23rd 2003, got a receipt date from INS for July 7th 2003. I am waiting for my EAD number. The receipt says, I will get the EAD number in 80 days from the receipt date. Here are my questions:
---- not EAD # it will be EAD Card
1. Can I try for the EAD number from the local INS office now? If yes, what documents do I need to take?
---- IF no RFE for I-140 then you can go to local BCIS office after 90 days to get IEAD, you need EAD filing receipt, I-485 filing receipt
2. Once I get the EAD number, can I switch to another employer?
--- Once you get EAD Card you can switch to other employer but your GC can be in problems as I-140 is still not approved and if you change employer your current employer may withdraw/revoke the I-140. Wait for minimum 6 months after filing I-40 and I-485. I hope your case is concurrent filing, read the BCIS Recent MEMO for 180 days it has been posted in many threads

3. If I switch the job to another employer now, what are the potential problems? What kind of inquiry will INS come up with to my Employer?
-----Your I-140 is not approved, employer may not respond to RFE, employer may revoke I-140 and you will not have any base to continue GC process, wait for 6 months to jump to new employer or you have to start GC process from the beginning
4. If my Employer is willing to continue my GC processing, even if I switch to another employer, is it easy for my current employer to handle the questions from INS?
----- If past employer is ready to reply any RFE to your I-140 and if Financial documents from company are to be asked he should provide all documents to BCIS, he should not revoke your I-140 for more info read BCIS MEMO. If you are desperate to jump then join new employer with H1 transfer because if due to any reason your I-140 and I-485 is denied still you can work on H1 status. Request you’re past employer to send reply for RFE for I-140 if any and not to revoke I-140
