File Cannot be located for 485 Interview

Hi, I did a search and could not Locate any other threads. I wanted to see if any one else has heared of a similar case before.

My 485 Interview was set for Sep 1 at Newwark office (middlesex county) but since my lawyer could not make the date, we got it postponed. My lawyer seemed to be very confident that he can get my interview rescheduled within 20 days.

I've been tracking this with him for almost 2 months now no site of an interview date yet. Further to that my lawyer just informed me that INS can not locate my File. Has anyone heared of a similar case before. I'm not sure how accurate this is and If it is true what does that mean for my Case.

Any input is appreciated.

Thanks,

-Kanwar

thats funny you should say that I know of a similar case in Hartford they got there for the interview and the officer was all embarassed as the file had gone that was in may time they were to wait for a reschedule but last I heard in aug they hadn't received anything.

sounds fishy

Sounds like it may not be in your lawyers best interest to have you approved. Is it possible he is trying delay tactics?

Next time you get a interview date, tell him if he can't make it it's OKAY (I guess you may have already decided to do that, right? -)

Anyways, loosing the file is proabable, but postponing the file and then claiming they lost it togehter sounds fishy to me.

Unless yr file has come to them after processing it would be difficult that they grant u a interview. Yr lawyer seems to be saving his skin since he has messed up by postpoining the original interview date & since u are not getting another one as yet.....

It is intriguing how the lawyer came to know that the file went missing NOW after you are after him abt the interview delay... ;)

------ you had the Interview letter that was sent to you and that letter has the officer A or B or C written on it who was supposed to conduct your Interview on particular day, take the copy of that Interview letter and give it to them they will know where your file could be.
Book Infopass, go to Newark and ask the immigration officer when you can expect your next Interview date. As the Local USCIS has not sent you any letter that they have missed your file no need to mention about this. I suspect your lawyer has messed up the case and you are also pary to it as I posted you in past that dont postpone the Interview date . if you needed a lawyer for Interview you could have taken any other lawyer. once you reschedle the date it is always delay.
Who sent the letter to Reschedle the Interview date? YOU or Lawyer? are you sure that lawyer sent letter to rechedule the Interview date? if yes Ask him the proof or copy of the letter that he sent to Newark for recheduling your Interview date. take that copy of letter also with you when you visit newark CIS office
