Fiance visa

I am wanting to get a fiance visa and my fiance is in China on a business visa, not a work visa, he is not a resident of China but a resident of Algeria. He has lived in China the last two years. I am wanting to apply for a fiance visa through the U.S. Is it possible, even though he is living in China but not a resident and on a business visa?

If your fiance' has residency in PRC, then he should be able to apply via the local US consulate. One does not need to have "permanent residency", but needs "residency". Even if it is a year long work permit or student visa for example. Now if he is on a short tem business "visit visa" that he keeps renewing by going in and out of PRC, that will not qualify.

you should know that a fiance visa is K-1, not F-1. F-1 visas are for students.
 
No he is not

No he is not a U.S. citizen. Let me try and clarify, I want to know if I can still apply for a fiance visa, while he lives in China, but not a resident of China.

For a K-1 visa, the sponsor needs to be a US citizen living in the US. The beneficiary has to be living outside the US.
