Fiancé here in the Usa ,Getting married ,Now what's next? What forms to fill out?

Hi,

My Friend's Fiance come here in the Usa more than a month ago,and they are getting married this weekend!,now after that,what are the forms that they need to fill out to send to uscis ? as the 90 days is faster approaching!

Before she come here to USA, they did sent in this forms:

*i-129f
*g-325a
*g-1145

Then they approved here and they sent all info to the consulate and they called here and give her
the visa,and then she come here.

Is she in the US with K-1 status? If that is the case, she needs to file for AOS after they get their marriage certificate. I-485 (no I-130 needed), I-765, I-131 and other ancillary forms.

Yes , K-1 as they did not marry in the foreign country, they will do it here ,this weekend,and she's been here in the USA for just little bit over a month.

So,

*I-485
*I-765
*I-131 ( travel document? why need this? just curios)

"other ancillary forms" You mean other forms related to the 485,and 131? if the instruction form asks for?

also how about the sponsor form?

Yes, that is what ancillary forms means. For financial sponsorship, I-864.

You can use your foreign passport with the green card to re-entry? unless foreign passport will expire in 2-3 days...

So this is a mandatory form to fill out? with all papers,before sending all to USCIS ?

Hmmm ,interesting , i was thinking that you need a travel document only if your foreign Passport one is expired and want to go out of Usa and then to Re-Entry!, just was trying for them to save some $$ by not doing the i-131 if they don't need to.

There is no fee for the I-131 (Advance Parole) when applied in conjunction with I-485. It is advisable to apply for it even if there are no plans to use it, because it takes 2-3 months to be approved and if something comes up that requires urgent travel it may be impossible to get it fast enough.

If your friend's fiance left the US after I-485 filing and before green card approval, their I-485 would be canceled for abandonment if they didn't have an approved Advance Parole before leaving the US. And once the I-485 is filed, they probably won't be let back into the US based on their visa or foreign passport alone; either Advance Parole or the green card would be required*.

Note that the same I-131 form is also used to apply for Reentry Permit and Refugee Travel Document, but Advance Parole is what is needed here, not Reentry Permit, and there will be questions on the form that are not applicable when applying for Advance Parole.


*there are specific visas such as H1B and L1 that would allow reentering the US with a pending I-485 without Advance Parole, but you gave no mention of them having such a visa.

Ok, i see that if they apply for the I-485 ,then no additional fee will b for the I-131 (type B or D) witch not apply to them.

What applies to them (Her) is Type A (re-entry permit ) witch there is a fee.

And She (They) will not travel any time soon to their country,maybe 1 later... But not now.

But will let them know ,if they want to apply now or at later time for the re-entry permit, i my self was in this situation had valid foreign passport and the green card and had no problem to re-entry, but if your foreign passport is expired,then yes you need the travel document to re-entry Usa.

So to apply for it, for the Advanced Paroled in part 2 check box 1.d ?

Other few questions:

*Regarding form I-485 and form I-131 (advance parole)
Do we have to pay the fee for form I-131? if you pay the $1070 for form I-485?

and sec. question:

*Regarding form I-864,

They did form I-134 before the beneficiary was called to Usa Consulate ,overseas,
so now you have to do I-864 all over again?

Also i notice that if you do form I-485 , i dont have to pay the fee to file form I-765?! is that right? based on the info here:

Part 1, this where i put fiance name? that come to USA? and how about line: part:3 (B) ?
