Familybase Immigration for Brother&Family

I am a US citizen and wanting to apply for my brother and his family for migrating to US. I know that the wait time is 12-15 yrs for siblings (4th preference) but wanted to know that since my brother and his family have a 10 year multiple to visit - Will the family based immigration application create an issue if they visit on the 10 year multiple..Also, my nephew is planning to do his further education here (is 15 now) in the near future..Will this effect his applications to schools here if he wants to come in on an F1 visa?

Please advice...

There is nothing preventing them to use a visa they already have. However, applying for a new one (i.e your nephew's F1 visa) may prove slightly more difficult.

But, even so, since there is nothing they can do (i.e. adjust status while in the USA) for at least 12 years... that should not prevent them from using other non-immigrant visas during that period, as there is not risk of them overstaying or filing for AOS as they would be if they were immediate relatives.
 
I should have mentioned that thier muliple visa (10 yr) will expire in 2010..Will they be able to apply again for a 10 year multiple if I have applied for their Familybased immigration?
 
They are entitled to apply if they wany. However with a pending I-130, overcoming 214(b) would be tough.

I have seen a case where a tourist visa was also deined because of pending application.Getting F-1 is nearly impossible.
