The allocation of visas obviously has to be revamped drastically for this system to work. FB2 could clearly use less Visas and FB1 should be getting the bulk of it.

From a different thread I posted this:

Problem is that they're not processing I130/I485 fast enough that the FB1 gets saturated. It takes 5 years to become a citizen once you have the green card, hence most FB2 categories petitions filed now become part of the FB1 category... granted the sponsor has since become a naturalized citizen.

FB2 petitions would need to be fully completed within 5 years not to affect the FB1 pool, and that's just not happening. Also remember 245i passed in late 2000... any FB2 applicants who have applied thru a permanent resident have most likely been upgraded to FB1 by now.
 
FB4 was moving more faster than FB3 so far, now time for parents - son/ daughters re union time. Let brothers/sisters come second.

It was moving 2yrs for every one year, but FB3 was moving 1/2 yr for every one year. ( 2005 - 77 Weeks, 2006 - 92 week for F4)
Question - Son/daughter or Brother /Sister, which one come first?

Oh well. At least F4 should reach the June-August of 1996 by Nov-Dec 2007.

F1 moved forward

As I understand, passing 22 April 2001 (F1) is a big deal. Someone told me that there is a chance that visa numbers will be available at a faster pace once this date is passed because there was a law during December 2000 and April 2001 which allowed a large number to illegal alliens in U.S to stay illegaly in U.S and then apply for adjustment of status by paying a penality fee. So more people filed immigrant visa cases for their illegal relatives during this time span. I don't know how true is this whole story, however Section 245(i) of the Immigration law was active from December 2000 until April 2001. INA 245(i) allowed people who were not otherwise eligible for AOS (out of status) to file for AOS with a $1000 penalty payment.
 
Mockba, you are right on the money but I believe as long as the application was postmarked prior to May 2001, that it would still be a valid application, hence there may still be quite some application from that timeframe with PD of early may 2001. Though most people scrambled to apply early, question remains how fast will it now be? If it doesn't make a big leap next month, then it'll still remain a neverending process. I really wish that the State Department released a breakdown of the numbers of pending applications in each category as they do with visa availability!
 
yea lol it moved 7 days (fb 4), i think ive seen fb 1 move forward one month, then beackwards the next month, so i dunno, and about the big jump, tht was because it was the end of the fiscal year, so they gave out the leftover visas i guess. yeah good for u pvs7 tht ur pd is in 1996, mines in 1999! haha, got myself like 3 years definitely. :eek: but all i can say is tht im glad the dates didnt move backward, although ive never seen fb 4 move backwards, i have seen it stop for one month, but then it moved again.maybe congress will do something about this, this year?? goodluck to ya all.

your discussion has been wonderful, i am a son of a LPR, although my father has had his green card since 1993, my petition was filed in october 2002, and was approved in 2005, now F2B takes 10 years to come thru,

i however wish and hope that congress can allocate more numbers to these visa categories, and i hope they also realise that these are beneficiaries willing to enter the united states with legal means, trust me even thoug am 27, having been separated from my father for 14 years already is enough torture and punishment, i want to believe this isnt wat the american dream is all about, and i hope the congress will pass a favourable amendment to the immigration act this year

hey guys, does n e 1 know if the congress is working on anything currently regarding increasing visa numbers or amnesty? the only thing im aware of is tht they've brought bk the immigration for agricultures i guess for the illegals, whtever thy had last year. if u do please share.
 
they will be working on sending more troops to iraq but to bring families together, they dont care my friend. its pity, that sons and daughters of us- citizens have to wait 6-7 years for processing. thats how they take care of their own citizens

Can anyone give their understanding on this:

I was wondering when did the 245(i) immigration law expire. Was it 22 April 2001 or the 30th April 2001. If it was the latter, then it is posible that there could be alot of persons still waiting to be process that did file in the last week of April, or most likely everyone would then try and avoid then rush, if not, then F1 could really be in for a long wait. Your input on this would be really appreciated

Not So Fast!

I have found the Memo pretaining to 245i and the final date was April 30, 2001 to file a petition. So that could meant that alot of petition were filed in the last few days from the 24th to the 30th...enough to dry up the rest of visa numbers left for F1, then we could see F1 stall until November if a immigration reform bill does not pass. The new priority date is May 1. 2001. but I think they only process applications receivedby the 30th. I stand to be corrected, if they are processing up to May 1. in F1 then this category could start moving real fast soon as the new quarterly numbers would be there to used without the 245i's. If one can check the archieved bulletins F1 was always "current" before the first 245i law was passed.

Hopefully it won't stall, and at least move by a week or so for the next few months and pick up at the former pace... which would be great!

I dont think you could get a PD after April 30th from what I read, but you were able to do so under emplyment category, I think that is why you are seeing most of the EB's lagging in movement. But my main question to you is does FB1 pass the April 3oth treshold? Are they processing those applications up to May 1? I guess I have to read the Visa Bulletin header.

And yes the dates were current when the first 245i law was passed I think in 1997, the one that came into effect in 2000 was a re-newing of the first cause it had expired.

Only applicants who have a priority date earlier than the cut-off date may be allotted a number. Immediately that it becomes necessary during the monthly allocation process to retrogress a cut-off date, supplemental requests for numbers will be honored only if the priority date falls within the new cut-off date.

With that said they are only processing applications up to April 30th and not May 1st. Then this really put a spin on things. They wait might just began if majority of the applications were filed in the last week of April. It takes 1 1/2 year to process those between April 15 to 22nd, that works out to be approximately 35,000 visas. Who said crossing the 22nd was a hurdle, here comes the taller one. Lets just hope most did file before the deadline.

Well my family has to wait longer, hope that next month bring some good movement, which is verrrrrrrrrrrrrrrry unlikely. Sorry for so much post in this forum, jus sharing my opinions and I hope you will share yours, dont just read..type also.
 
same here, i really dont think there will be any movement forward for fb1 until summer. btw, nice law (245(i)) causing fb1 not to move almost 2 years! keep it up!! :mad:

so basically the 2451 law creates a backlog, i wonder wht they r thinking? maybe they want america to remain popular for immigrants i guess, so they making a very looooooooooooooooooooooooooooooooooooooong chaing of ppl n their families. just running out of patience here, so i get it the congress is working on nothing for increasing visa numbers. which sux, but they just got started, so maybe they will do somehting after they finish their 1st 100 hours of work. fingers crossed.
