Factors while applying for a new TN via e-file

If an existing TN holder applies for an additional TN via e-file:

1. Can he start working for the new firm right away after filing the application(getting the receipt#) even without getting the approval?

2. If the answer is yes for 1., and his TN for the same application is later rejected for any reason after a couple of months, would he considered to be a valid employee of that new firm during that period of 2 or more months?

3. Is there a limitation/requirement on the size of the TN sponsoring company? Could a small firm with a few employee (say 5) would still qualify for a TN?

1. No. This only applies to H1 applications on behlf of those who already have h1

Thanks Nelsona, so I am guessing that the only way a person can start working for a new employer immediately is by getting TN from a POE or doing a premium via mail. Is POE a good option at this time?
 
Thanks!! what's the best approach of applying for a new TN while retaining the old one. They usually want the old I-94e back at the time of issuing a new TN.
 
You tell them you are applying for a second TN, plain and simple. They only take the other I-94 if you stand there and say nothing.
 
One last question. How should I justify and distribute working hours b/w two jobs incase if I am working only on the new one and retaining the old one for some later engagement with the same company? What are the grounds on which 2nd TN is usually awarded?

If you are going to give notice to Firm A as soon as you get your 2nd TN, then simply explain this to the POE; they will let you keep 1st I-94 and issue 2nd.

If you are no longer employed by the Firm A, then you should not be keeping the first TN issued on that basis. If you are going to change your relationship with firm A (or for that matter, Firm B) to that of a contractor, then you should get a new TNs with letters which state this.

I'm quite sure it is the same procedure at POE but Me as a Mexican, i have to go to a US embassy in Mexico in order to get my additional TN Visa, as I have a current TN Visa that will expire in 2 years from now.
Once at POE should I show both and will i get two I-94? does that mean i should fill out two I-94 forms at the airplane?

Yes, you need 2 TN cards. Your current one should still be in your possession, plus you need a second one. The difference will be the name of the sponsor written on it by the agent, and of course the expiry date.

You shouldn't get 2 new ones; one is already existing, and should be kept by you at all times.
