F2 to TN, Application withdrawal, Canada immigration

hi guys,

I am an international student pursuing PhD in one of the state University with another 2 years of study left as per my i20. Recently, my fiancee who is a Canadian Citizen got an Application withdrawal stamped on her passport while she was planning to visit me. Now she is afraid and don't want to take risk again, which I totally agree with.

Now, we are planning to get married and will try our luck with F2 dependent visa.

My questions are..

1) Is it safe to try for F2 after Application Withdrawal stamp?

2) Is there a possibility of getting her f2 visa changed to TN upon getting a job offer?

3) How will this affect on keeping my immigration file in Canada after marriage?

4) is there any other option which I may consider?

Obviously, she did not satisfy the requirements of entry on B2 visitor status. That was either because (a) she could not convince the border that she had sufficirnt ties in Canada to be likely to return to canada or (b) they felt that since your presence in the US was long-term, she was very liklely to stay past her 6-month limit.

1. It was a good thing that they allowed her to withdraw her request for entry instead of registering a denial of entry. She needs to satisfy the agents next time for whatever they told her she was lacking. It will not impact her eligibility to enter in future as long as she qualifies for that status.

2. She isn't eligible for F2 until she marries you, so she might want to first look act more like a Cdn resident to be allowed entry as toursist. She will need this even if she wants to look for work. Either that or find a TN job online and move.
3. No effect. It doesn't even affect he US immig, so whay would it affect your Cdn immig.
4. Fly to a third country and marry there.

I am planning to get a Canadian visitor visa and we have plans to get married in Canada. Is that a good idea or we should consider third country?

Once we get married then she can come here in US on F2. Can she change her F2 status to TN upon getting a job offer?

of course change of status(es) can happen provided one is eligible for it. If she's in F2 status and she gets a job that qualifies her for a TN, she can petition USCIS (or go to the border) for TN status
 
I only mentioned third country incase YOU get into the same hot water SHE did, by not having sufficient ties in US. If you can get into Canada and marry, then F2 becomes almost automatic the next day at the border.
