f2- greencard in process- want to study

hi there,
my question is- i came here on Student dependant visa ( f2) and my husband has filed for green card and being a dependant mine was also filed...i got my receipt as well as my EAD. but i am willing to take admission for part time or full time LL.M then what would be my visa statues? is it changed or still it is F2? do i need to take F1 visa from that college? bze i think on f2 status i cannot take admission... plz reply i dont want to lose my admission this yr.

Ok, if I understand correctly, your I-485 has been filed, correct? Did both of you submit your I-485 applications at the same time?

The bad news is you can't study towards a full time degree on F-2 and can't apply for F-1 because that's a nonimmigrant visa. The good news is that with a status of "AOS pending" you should be allowed to study. Contact the specific college and ask for what documentation they need to accept you as a student with "AOS pending" status.

Not to confuse you, but if your husband didn't violate F-1 status and you didn't violate F-2 status, you might both still be in valid F-1 and F-2 statuses even though your AOS is pending. However, if either one of you decides to violate your status (start to work on EAD, or your husband doesn't enroll full time, or you start full time college) then your status goes to "AOS pending."

Based on what you are saying u can study full time and pay in state tution fees like a permanent resident would pay.

Check with the international student office of the university before u check with the regular admissions office as the prior one has more details available.

thats not quite true. she has to be a resident for more than a year in most states to qualify for in-state tuition
 
i am ready to pay tution fees like international students.. only if i want to take f1 visa through univ. then i need to show all financial documents n all and my q is if i have filed my green card then how come i apply or take f1 status? i have asked to college they told if i am eligible through my visa status then i can & only i need to fill up the fee before the 1st day of college.. thanks for ur suggetions... i am applying lets see what college ll do.
 
Sorry if I was not clear enough before. F-1 status is only for students who temporarily study in the US and have no immigrant intent. You have applied for permanent residency and along with the permission to work during your pending AOS, you have the permission to study. But, please do ask them what specific documentation of your AOS pending status they need (e.g. your I-485 receipt notice). It seems perhaps they don't care and take your word for it? Just be prepared that they may be much more familiar with F-1 than your pending AOS status.
