I have a friend who is an F1 visa holder. She received the F1 visa to come for a summer program last year. She never attended the program and has stayed on in the country till today. Her boyfriend is American and they are planning to get married.
I told her the chances of being able to adjust status are slim to none because USCIS scrutinizes the F1 visa holders and in her case because she did not even attend the program, she is unlikely to be successful. I want to tell her to head back home before she comes up in the SEVIS system or accumulates illegal presence.
Am I correct? Or so far as they can prove the bonafides of their marriage she will be approved?
