Hello:
I wanted to know if I have completed 1 year outside US. I left USA on Oct 30, 2004 and continued my project work from India till May 2005 on H1 although I was out of USA and my work location was outside USA. I have never been to USA and not plan to be in USA till Oct 30, 2005. If I apply for new F1 after that, will I be able to get it. If On H1 Will my 6 year clock will start again.

I have been on F1 in USA again so I wanted to ask if I can be on F1 again as I had been on H1 and F1 previously? I am aware that second on F1 you cannot get OPT.

Please let me know your opinion and if anyone ever faced this situation, I hope not.

Thanks

If you apply brand new H1 under quota

Hey:
Thanks for your response here. I guess once the person is physically out for 1 year no matter whether he was working on the job via India, he is eligible for new H1 under new quota.

Thanks again

if you are getting a higher degree than the last time, you can get a new OPT. That is, if you got a bachelor's degree and OPT last time, and this time you are getting a master's degree - you get a new OPT. Rules have changed over the years.
