F1 to Green Card through CP need help! Interview coming in Sept.

My husband and I are scheduled to have the interview in Sept. We are currently in the US under F1 status. What happens if we don't get GC? Able to go back to school in the US????

Please need advise ASAP.

Help greatly appreciated.

Hi Lola,
you can read my experience ( link in my signature ): my husband and I were also F1 students and we chose CP.
My F1 visa is now cancelled ( " cancelled without prejudice " stamped accross my F1 visa ) because we were successful ( got the GC ).
Honestly, I am not sure of what happens for a non-immigrant visa if you are not approved for the GC. I would have said that unfortnately, you're screwed, as I think it's the risk involved with CP.
But I would say you've got a very fair chance : you are F1 = receiving US education => IO love to hear that : you're smart people and so on...

Since you are applying through CP, your non-immigrant visa should not be affected due to GC denial UNLESS they cancel your visa.
If you meet all the requirement for F1, you should be able to come back.
However, since you already has shown immigration intent by applying for GC, F1 renewal or entry to the US may give you headache.

Ok, I'm F1 and my wife won the visa lotery, so next December if we are lucky we could have interview also CP. I'm leaving US in a couple days and coming back in September, I think nothing is going to happen to me or to you in case you dont get the GC. I talked to my advisor and my visa is fine to come back, as an example my wife got approved change of status from F1 to F2 just few days ago and all this after filling all document in of notification letter and showed intention to immigrate. dont worry you will be fine.

My question really had to do with the fact that I have the visa stamp on my passport, but my husband doesn't. So in case the interview goes wrong, my husband would have to apply for his visa.... He changed from F2 to F1 and hasn't left the country since.

I'm keeping my fingers crossed and collected alll the documents they require.

Could you tell me how long it takes to get your passport back, if approved, to come back to school?

My husband and I got the first letter in April, 2005, and reply right away. I left the US for a week in January and had to go to the consulate to get the visa stamp (F1), and got it.

So I particularly don't think leaving the coutnry would be a problem for you.

Just curious. For your case, if u both leave the US, u will lose ur F1. Student visa only valid in the US while studing.

if the visa is not expired(valid 3 years) they can come back if it isn't revoked. There are multiple entries on the F1 visa. I may be wrong...
