F1 Status ....am i eligible to do aos

Hello everyone,

I am in F1 status and my visa going to be expired by the end of this month but i am still in status and will take two years to graduate. Am i eligible to adjust my status here? I f I have to do cp preocess then i will have to leave US and there is no sure of getting gc and will have problem coz my visa will be already expired.

Also my CN is AS****4036. So any suggestions pleases. I heard that KCC will not process the F1 status case here to adjust status.

Your response are highly appreciated.
 
If you're in valid F-1 status and have not entered the US within the last 90 days there shouldn't be an issue adjusting status.

I emailed to KCC about my eligibility for AOS and they replied as follows..

The adjustment of status fee to the Department of State has been paid or indications on your DSP 122 show that you wanted to adjust your status in the US. The payment of the adjustment of status fee indicates to KCC that you are residing in the US and wish to process your case at the CIS. As a result, KCC did not continue the processing your case.
To continue this case to consulate processing, please notify KCC with your request.

I dont know why they emailed me like that. I did not ta inquiry. I did not talk about the fee on my fee. what does this imply people? I am so confused and nervous and I cannot take risk doing cp.

But i know I am in F1 status and also I have been to overseas on winter and back to US on mid jan, which excedd the 90 days reuirements.

Guys need help.....

I would be engaging a lawyer if I were you. You want to make sure you handle this all correctly to make sure you can do the aos and not screw up your F1.

I have read the thread but i could not fina any more information for F1 student.
I have my friend here who did AOS and got the GC. So i did exactly what he said and sent the dsp122+barcode+2 photos. But on the same delivery day I received email from KCC after my inquiry and got the response as i posted earlier. Now I am really worried that I have been said my aos cannot be done and I have sent my dsp 122 mentioning for AOS. So whats gonna happen in this circumstances.

Another thing i dont clear understand what KCC replied me about. They were talking about the fee and I have not cahesd any fee and did not talk about it on my earlier.

I need a great advice here....I am really worried about being lucky as looks like things turning down.

I doubt KCC received your documents THE VERY SAME DAY you mailed them, unless you used express mail (overnight or 1 day delivery). Maybe the e-mail was sent to you in error. It happens. Even if it wasn't, all it says is that KCC is no longer processing your case due to the fact that you've chosen AOS. This is standard, as long as I know. You can most definitely do AOS. Once you get a clear confirmation from KCC that they have your forms and that they know you want to do AOS, all you have left to do is keep an eye on the visa bulletins and be prepared to send your documents and payment to USCIS when your case becomes current.

The fact that you did not send KCC any payment makes me think that the e-mail from them is erroneous or a misunderstanding. What you can do is either give them a call to find out what's going on or e-mail them again. Since you're already in the US, giving them a call is very convenient.

KCC just received it today. Can you tell me hoe long it gonna take to respond them and notifying me about further processing.
And also, Do i have to sent a fee now or wait for KCC respond?
 
You can Do AOS don't worry, and your case number is good, what to do now ! you need to wait, within a month KCC will send you an email to confirm the AOS and the payment instruction, then you need to wait and monitor the Visa Bulletin, the first day when your case becomes current fedex the AOS package to uscis, be advised now not to Leave the USA until you receive your green card next year, or until you receive AP when you send your AOS package, Stay in status in order for you to do AOS

Seriously?? You gotta be kidding me. Please read posts with bold "F visa" paragraphs!

Since you already sent your dsp form, there is no reason to warn you about being careful anymore. Hopefully you did not extend your I20, renew your F1 visa, change schools, apply for OPT, arrive/comeback to US, or start your program in the last 90 days, and never have been out of status in the past. If no, you will be fine.

And please read the thread and ask your questions there.
