F1 stamping in Mexico, what are my chances?

Hi guys,

I've been living in the U.S. for 2 years on H4 status. My dad has been living here for 5 years on H1B and my mom 3 years on H4. They have both applied for GC. I turned 21 and had to change my status to F1. Got it changed recently. Now I want to go back to Russia, and need to get visa. Since nowhere on the approval notice does it say that I have to get visa in Moscow, I'm going to Nogales, MX. My friend got his H1B stamped two month ago there. But his parents live in Russia. While I was on H4, I went to Russia twice and then back to the U.S. Am I gonna be considered as a potential immigrant? I bought an apartment in Russia and it's registered with my name. I have a paper stating that. Would this be enough to prove that I'm gonna go back as soon as I graduate? Also, how crucial is TOEFL score on the interview?

And just to share with you. I've been reading through this forum, and ppl say that you can't come back from Mexico if you are denied. I think you can since you don't need passport to cross Mexican border till Jan 1, 2007 if you are traveling by sea/air and till Jan 1, 2008 or 2009 by land. All you need is either combination of your ID and birth certificate, or just a tourist card which can be obtained in any Mexican embassy in the U.S. or near the border for $25.

You are a potential immigrant (period) and applied GC and your parents are here and applied GC too.

You have 100% immigration intend.

Having an home in Russia will not hold any water, home can be sold over night and you can bring the money to US.

So you have more burdon to prove yourself, that you are a non immigrant.? That is impossible in your case. Avoid going to Russia until your GC approved

Thank you for your reply. I got confused and just talked to my lawyer, and she said that the documents for GC for my parents have not been filed. I don't have a file either. My dad is a holder of H1B and his company applied only for his Labor Certification. That's it.

What are my chances in this case?

BTW, I'm going to Mexico to get my visa, not Russia. It's impossible to do that in Russia :)
