F-1 applying for U.S. Permanent Residency

Hi all,
I read on title "F-1 applying for U.S. Permanent Residency" something like,

By applying for a U.S Permanent Residency an F-1 nonimmigrant student would be considered as to having abandoned his status. The applicant will no longer be eligible for an EAD under the (c)(3)(i) category.

I am currently in F1 status and got a NL with case no 2008AS00011XXX. Now if i send the forms to KCC for CP and my case no never becomes current then can i apply for OPT after my graduation or should I leave US immediately after my graduation.

Technically its illegal what you are doing (since you have immigrant intent), but they probably don't share the data and they won't notice until you get approved at which point the EAD situation is moot anyway.
 
this topic is a year old.

In case of CP and the number never becoming current, a person can still apply for OPT. There are no questions as to immigrant intent on EAD application.
