I have got pre approved EB2 labor approved May'01. The August visa bulletin shows that the visa numbers for EB2 has become unavailable.

If I am able to file my I140/485 concurrently before 31st July, then will I be able to get through?

Will my I485 be considered filed and be eligible for EAD etc?

Do I need to do the medicals examination before filing I485?

In my opinion, yes.
Will my I485 be considered filed and be eligible for EAD etc?
Yes..you can apply for EAD along with I485.
Do I need to do the medicals examination before filing I485?
I think yes..to be on the safer side..some there are some instances where in applications were submitted without medical exam..in that case they will issue RFE later..but it is better to submit along with your petition..look for a USCIS approved physician and make an appointment..it won't take that long..

You should do it, but you also send without medicals, which in case you will get a RFE later.

I am getting my 485 in before the july31. I think I am done and the lawyer after review will mail on Monday (hopefully). The main things you need

1. Get your medical tests done on Monday
2. Birth certificate (if you dont have it)
3. The rest are docs you should have...so ask the list from your lawyer

The medical tests will take 2-3 days. One advice...they will give you a TB test injection (ahigh percentage from India test +ve). Then they will ask to take a chest Xray which will come -ve. I would suggest that you take both on the same day....in my case the tb test came +ve and then I tool the injection...so lost an extra day...which might be critical to you.

I think they need to receive by Jul31...you should try to send everything by fedex overnight mail on 7/27(thursday) to be safe....

However, my wife's birth certificate in NOT in english (its in Hindi ... all everything in hindi).

She has her school certificate specifying the date of birth. Will that be sufficient or I need to get her birth certificate translated?

Anybody can sign the translation, who knows hindi. It will take you ten minutes. I bet you know a few guys who can honestly sign that they know hindi.

i saw some web pages that illustrates the translation. Incidently, that was a notarised translation.

So, I thought that I will have to get a translation from a lawyer or a notary who knows Hindi and I am finding it real difficult in DC area.

Please also tell me if you know some notary translators ...

Can you help me locate any reference from a web page where it states that anyone knowing that foreign language can legally tranlate for 485 filing purpose.

Getting a notary signature means that the person signing it says that under oath and in front of a notary. So the responsiblity of those statements are still with the person taking the oath and not with the notary. It doesn't mean that notary has to know Hindi or in some other case verify the fact mentioned in the letter which he notarizes.

I think if it is just translation of your wife's birth certificate my guess is that you can do it and get it notarized if you are proficient in Hindi. If it is an affidavit for your wife's birth certificate then it should be from your wife's parents or somebody who is elder to your wife by around 10 years like uncles or aunts etc stating that they were present at the time of birth etc and get it notarized.

Service Centers are closed on holidays and generally overnight deliveries are not available and generally deliveries to their P.O. boxes are considered not "filed." The cases must physically reach the Service Center facilities within working week days. July 31, 2006 is Monday.

if you file it via U.S. Express Mail, and you use P.O. Box, it stays with the PO Box until the Service Center picks it up. Remember that a case is considered not filed until it physically reaches the Service Center facilities and date stamped.
The U.S. postal service is not the best services when you face such deadlines. Additionally, using a P.O. Box will turn out to be another mistake. The packages delivered to the P.O. Boxes are picked up by the Service Center mailroom crew, usually in the morning, and any mails that go into the P.O. Boxes remains there for the next day pickup the Service Center. People may as well use street address and commercial overnight delivery services which also give the evidence of shipment and delivery.



The I-485 form lists the following evidence as the initial evidence for the employment-based I-485 filings:
Birth Certificate
Copy of passport page with nonimmigrant visa
Photos
Biometirics (currently after filing)
I-693 Medical report
G-325A Biographic Information Sheet

Notary does not need to know hindi - he needs to notorize the signature of a person who certifies that he does.

All my docs had been signed by my collegue (and I have actually signed his papers) with no notarization, and no problems appeared.

In any case - that would not be a kind of aproblem that would preclude submitting paperwork anyway.

Just type under the translation "I, XXX[your firend], know both hindi and english and certify that the translation is correct" sign, date. That's it.

You can not. It should be someone not from family.

Translate it youself. Get a friend to sign it in front of notary.
