Extremely Upset !

Friends,

I received my receipt for my N400 on Sep 25 2009. Both, me and my wife got out FP done on 10/23/2009. Wife got her citizenship in early Jan 2010.

My status online still says they have mailed me an notice/RFE (which is the FP notice).

Today I went to the USCIS office and they checked my case and said that my FP is not even in the system and that is should have showed up in the last week of Oct 2009. So I got a new FP notice printed from them which is in 3 weeks from now.

My question is how did it go missing for 8 months and is there anything I can do about this?

Rajiv - Not sure if you monitor this forum. If yes, any advice from a legal standpoint?

So how did you find out your FP went missing? It's funny that my wife's status is also the same but her citizenship came in. Just curious, thanks.
 
Looking at the post one is not certain if you made efforts earlier. The onus is on the applicant to pursue the matter. May be you are too busy or assumed USCIS will solve the problem by itself. Unless you act the system may not by itself know you are alive .
You must be one of the rarest case where FP lost in transit. May be you could have acted early.

Nothing much you can do about it now except try to go for an early FP walk in.
Have you done any inquiries about your case in the last 8 months?
 
Will going to the local congressman help?

Your case should be back on track now. So the congressman can not do much anymore ... 3 months back - maybe, but then you could have done it yourself.
If you are trying to change CIS processes or get an apology through a congressman, good luck with that.
 
Yes, I did call their number in Jan '10 and they stated that the delay is because of FBI checks. :)
Their standard boolsheet answer. FBI checks don't delay the scheduling of your FP appointment. You should have made an Infopass appointment long ago.

Anyway, nothing you can do about it now except go for the FP appointment and follow up with an Infopass if you have no interview appointment in the next 2-3 months.

i would not wait for 2-3 months. Call 30 days after finger print and if no joy Infopass within 6 weeks. You have to "Grill Baby Grill " the USCIS. Within 3 months you would be a USC. All the luck
 
When you are done giving your fp's to uscis, call the FBI the next day too see if your fp were sent back.
That's how you will know if your n400 application is moving forward.

You can try to do an early walk-in finger-printing, before the appointment day.

After you are done with FP, you can call the FBI
at 1-304-625-5590 to verify that they received and processed your fingerprints from USCIS. You'll need to give them your A-number. Usually the FBI does the fingerprint check very quickly and returns the results to USCIS within 1 day.
