hi

I have first entered US on B2 (business and leisure) Aug 07, 2009 and departed on Feb 01, 2010. later after the month again i was entered on 10 march, 2010 on B1 for business at POE officer has not asked any question and stamped I- 94 till 10 June, 2010 (for three months). I am in to consulting business and to finish my work i need more 4 months of stay. My question at this point of time is that it is advisable to ask for more 4 months EOS or i leave on time and re-enter to finish my pending work.

If I file EOS before 10 June, 2010 and will stay to complete the business am i be out of status after 10 June, 2010 ?

Kindly looking for the inputs on the above scenario.

Thank you.

You are very close to the fine line where using your B-2 visa becomes abusing your B-2 visa. Your first visit was nearly 6 months long. You left for less than 6 weeks and returned for another visit. I am not surprised your got a restricted entry for 3 months instead of the usual 6 months. Now you want to spend another 4 months beyond that. In other words, you want to spend 13 months in the US within a window of less than 15 months. Do you honestly consider this a pattern associated with a genuine "visitor"?

You may apply for an extension if you have a bullet-proof life and death emergency. Bear in mind, if your request is denied, then you may have issues on your next visit to the US. Worst case scenario, your multiple entry B-2 visa may be revoked. I strongly advise you not to seek an extension of stay. Limit your visits to the US and space them out so that you never spend more than 6 months in the US during any rolling 12 month window.

OP should check the rules for the B1 visa program to verify that his work activities are among those permitted on the program. His brief description leads me to wonder if he is not in violation with the terms of his visa in regard to the business activities that he is conducting.

If there are any doubts, OP should consult with an attorney.

Thanks for sharing your views. I appreciate your time. I am filling EOS if I m not getting any rply within 1 month I will leave, immediately.

Does it make any impact on my visa if I m leaving after my i-94 date and holding the eos receipt.
