Extension of Mother Visa

My Mother is visiting us and her stay visa is expiring Nov. 21st.We want to apply for extension of her visa as my wife is expecting and due Ist week of Feb. Will that be a justified reason to apply for an extension or we could give a better reason viz a ceremony.

I have read that the visitor visa extension should be applied 4 to 6 weeks before I-94 expire. Also, as per the current processing times, it is taking 4 months to process applications for I539. I will greatly appreciate if someone could suggest the suitable time to apply for her extension. The visa fee for I539 is going to increase from July 31st and 4 months waiting time indicate that it should be sometime in July.

Thanks much..

You can use your wife's pregnancy as a justification to extend your mother's stay. Whether it does the trick or not, no one can predict. You should apply 30-45 days before her stay expires. Good luck!!!

Well i would refrain from using your wife's pregnancy as a reason for extension. USCIS can interpret this as helping in the household OR babysitting the new born. A visitor doing this esentially takes away a job of a U.S citizen. People have been denied extensions / visas for using this reason. It will be better if you consult an immigration attorney if you decide to go ahead with the extension OR the other option is you send your inlaws back now and have them come again during the month of Nov.

If the extension gets denied, you need to be aware of the consequences that may arise at your next entry.
