Expiring GC/Divorce Situation

I will try to keep this short winded. My husband is from england, we got married over 2 years ago. His GC will expire on 5/24/07,i guess it is a conditional residence green card although it says permanat. We married for legitimate reasons, loved eache other, and went through all of the motions and interviews. We are supposed to file I751 (?) before his gc expires in may. He is leaving me, and we have a child, 6 months old. He said he will not file anymore paperwork because he has a child and he will not get kicked out of the country. It just didnt work out like we wanted...at all! My question is, will I get in trouble if he leaves? What are the ramifications to him? And do we HAVE to stay together for 3 years? I dont know what to do, he turned out to be a jerk. HELP!!

If he has a conditional green card (I assume you're a US Citizen and sponsored him), then he MUST file the I-751.
Failing to do so before his GC expiration (he can file as early as end of February), would make him lose his status, regardless the fact that he has a USC child.
You should tell him. He will eventually get kicked out of the country and he will have to pay child support no matter what.
 
You won't get into any trouble just because the marriage didn't work out. Try to talk to him again and get him to understand that he will lose his right to remain in the US if he doesn't file the 751 as scheduled and thus his right to work legally. :o
 
This is the first time where I have heard that the US citizen is keener to file I-751 than the GC spouse. Your husband HAS to file I-751. He will be the only one at loss if this does not happen. You have nothing to worry. It seems you will surely cooperate with him (kudos to you) if he wants to file a joint I-751. Try one more time to talk sense into him.
