expired tabs and got a ticketand oath ceremony on July 16nth

Hi,
My wife received a ticket as we had not noticed that our tab was expired. We usually get info from the Department of Transportation that it is time to renew our Tabs.This year we had not received the notice from the departmrnt of Transportation as we moved to a new home. My wife changed her addresss on her driver's license, changed addresses on both of our vehicles but the county clerk failed to update the information about the car which had epired tabs. We renewed the tab on thed same day we got the ticket. I spoke to an hearing officer and he dismissed the case without paying the fine. My question for anybody to help is on N-445: How would you respond to question about been arrested, citied, detained or paid fines for tracffic violations since the interview( Yes or No). If we say yes should we show that the case was dismissed. Your opinion will be very helpful.

I would mark 'No' as this was NOT an error or violation on your wife's part. She did everything she was supposed to do and the city government official goofed. This is clear from the dismissal of the case (with no fines associated).

If you have any documentation regarding this, take it along with you to the oath ceremony. Make sure the documentation you take clearly shows the error was not on your part and the dismissal.
 
To be safe, and to be xtra careful: Answer YES, and show the proof that it was taken care of. Later after many years, no one can find any excuse of you not being 100%, 200% truthful on the Oath/N-400 (while chance of any problem is miniscule, just be xtra careful, and finish the journey and sleep well from now on).
 
The tags are not always on the windshield as User says, in Calif they are applied to the lic plate.

What the op got most likely was a "fix it " ticket where the ticket is cancelled upon "fixing" the problem.
 
Are you saying that your wife was stopped by cops on the road and cops issued the citation for vehicle registration's expiration date?

Well, you were responsible to renew your registration even though it is dmv's fault, but you already had the hearing officer fixed the issues without paying fine. If I were you, I would say no to the question, but it is better to bring the proof that it was solved by hearing officer without paying fine and ticket with you to oath ceremony. Just ask the immigration officer first before your wife turn in her N-445 because your wife will tell the truth. Sometimes citiation/violation was still on your wife's driving records at the dmv so USCIS is checking dmv later. It is always bureaucracy.

the answer is NO---- NO ---- NO ----- they are county records, local records, nobody cares about them... they are not networked... these are local taxes in form of fines... not moving violations or misdemeanors or felonies....

You guys have to stop being so paranoid !!! :cool::cool::cool:
 
If you look up the State Revise Code (State Law), Driving with the expired tag IS consided as "TRAFFIC VIOLATION", and it is an individuals responsibility to keep the tag current and notify DMV for any change.

With that being said, it will not pose any difficult for your Oath and/or to become the US citizen. Just simply answer "YES" to the question and show the receipt that you have paid the fine and re-newed the tag.

That's IT!
 
If the ticket was cancelled after the veh reg was paid, why declare it? If you did not have to pay the fine then does that not mean there was no ticket ?

I fully agree. NYS has a similar law when it comes to certain traffic violations. For instance, if a vehicle is pulled over for a broken light and a ticket is issued, the driver has 48 hours to repair the light and bring the vehicle for inspection to a local police precinct. After a police officer inspects the vehicle and the results are satisfactory, he/she issues a clearance slip to the driver. The clearance slip is then sent to the main DMV offices in Albany and the ticket is dismissed (canceled). Such a ticket is not recorded on the driver abstract. It's as though it never existed.

If no record of this ticket exists, why disclose it?
