expired passport!! did not realise it

I am sorry for posting this here but I dont' know which is the right forum..

I am here on an H1-B visa (previously on F1-B). my passport expired on Aug 20, 2008 and I just realised it!! The indian embassy has the next "appointment date" on october 1, 2008.

Am I out of status? My H1-B papers etc., I-94 card are all valid.

Kindly advise.

I was searching for this on the web and university pages containing information about maintainence of legal status.

one of the requirements is that you hold a valid passport at all times... which would mean that you can't stay on with an expired passport even if all of your other papers are valid?

I thought I am out of status after reading that....
 
You cannot extend H-1B status until your passport is valid. But you are still legal with an expired passport.
