entering US with 1-797 and previous visa stamp

I apologize for posting this question as similar questions have been posted before but I just wanted to get a definitive answer.

I have a H-1B (I-797) and visa stamp valid till Jan 2006 in my passport.
However I am switching to a different employer who will file/has filed my H-1B extension.

when I get the I-797 from my new employer can I enter the US again (either by car or plane) without a new H-1 visa stamped in my passport. If so what should I tell the officer at the airport/border?

Secondly, if for some reason my H-1 transfer is denied and I have already quit my previous employer, what recourse do I have.
 
You can show the previous employer visa stamp and current employer I797 approval to enter US. Tell them the truth.
If the h1 transfer is denied, you can try for another H1 transfer. If you try to enter US and the previous employer has cancelled the H1- you will be denied entry into US.
