Entering US on H4

Hi,

I have a H4 visa stamped (valid till Oct 2003) on my passport. Staying here in US, I applied for H1 Visa which got approved. I started working here in US with that approval. Now my question is:

1) Can I go out of US and re-enter US on H4 visa?

2) After coming to US, can I still continue working using my approved Work authorization?

I have a bachelors degree (just 3 years degree) and just 2 year experience. I am not in IT either. I am worried if I can get H1 visa stamping done....hence these questions.

Please advice,

Ranju

answers...

Assuming your H4 stamp is also valid here are the answers
1) yes U Can go out of US and re-enter US on H4 visa but...

2) You will abandon H1 status by doing so.
Only option if you do not want to risk rejection at a US consulate is to hunker down in US until you get a green card.

However, if your speciality is a valid one and the general requirement for that job matches your educational qual & experience you should not have any problem. What does the edu evaluation say?

Thank you for your reply and advice.

My education valuation mentions that my degree is equivalent to "Bachelor of Science" in Accounting. I guess this is how I could get INS authorized work permit.

I am little worried of my H1-B visa rejection if stamped in India. Still I will try to get it stamped there in India. Even if it gets rejected, I can come back to US on H4 right?

Thanks,

Ranju

yes

yes. dependent visas are less stringent. howver, if you are rejected on H1 and then U come back and apply for H4, there is a good chance that h4 will be rejected.
Reason: consulate people say that with H4 U will come into US , cheat US authorities and reapply for H1...

So it all depends on your H1 rejection and the reasons that DOS cites....
