entering on H1-B visa stamped for the old employer

Hi all:

I want to travel to my home country on an H1-B Visa that was stamped for my old employer and come back. The visa is still valid and will expire 30th Aug. 2005 but my employment status has changed because I took a better job with a different employer.

Can I safely come back to US on the same visa stamped for my old employer. I do not want to spend more than one month of time in my country of origin just for the sake of stamping my H1-B visa.

Please, suggest or share some expereince if someone has already entered to the US with the situation described above.

If you have a H1 stamped in your PP and the date is still valid, you do not have to get a new stamp just because you changed you employer and got a new H1 approval notice. So you should be able to come back to the US with old stamp and new approval notice. Hopefully you will also get I-94 up to the full duration of you new H1. The only issue could be that your H1 stamp is expiring soon (Aug 2005). In my opinion, if you are planning to come back in July sometime, it should be fine. If you come in around end of Aug you may be asked why you did not get H1 stamped in your home country.

Thanks for the quick reply. What documents do I have to carry apart from I-797 Form to ensure unquestionable entry at POE.
