EMPLOYMENT STATUS AND FILING FOR SPOUSE----Help Please!!!

Hello Everyone,
I am and filing for my wife, I lost my job in January around the same time we got married. We want to file the papers the end of April. The thing is I am a USC but have not been living in the country for the last two tax years, I was attending school also. I got a job but the company that I was working with for in the 2009 tax year had been collecting taxes from my salary and not submitting them to the government. I found that out when I wanted to file taxes this year. I contacted the IRS and they are gonna investigate the matter.
Now my wife is working illegally and can meet the income requirements for the poverty guidelines for filing the forms but we are not sure if we should put her income on the I-864 and if my unemployment and status with the tax returns will be detremental for her.

Please give me your advice as to what can be done.

Income from unauthorized cannot be used for the affidavit of support.
 
If you're living in the US now, being out of the country in the past doesn't affect your eligibility to file for her.

Thanks one more query will it pose a problem if I am unable to produce 3 years worth of evidence for the W2's. I came back in 2008 I have been attending college and have just began working in March 2009 only to find out about the fraudlent tax submission from my previous employers?
 
If you are getting a co-sponsor, lack of W-2s on your part will not matter.

Is the co- sponser the joint sponser and does that person have to produce W-2s?
I am presently dealing with the IRS to get my W-2s hopefully I can get them before we file in April.

The co-sponsor needs to submit a I-864. The co-sponsor would need to submit copies of their tax return and W-2's or a tax transcript.
 
Yes, co-sponsor and joint sponsor are the same. The actual wording USCIS uses is joint sponsor. If you are only using one joint sponsor then they check off box D on Part 1 of the I-864. They need to also include proof of US Citizenship or PR status.

When you fill out your I-864 you are going to check off box A on Part 1. You don't have to include a copy of your citizenship on this form because you included it with the I-130.

When completing the affidavit of support...Part 3 asks if you are sponsoring the principal immigrant... if I am unable to do so at this time should I choose Yes regardless of my unemployment status, or would it be better if I produced two joint sponsors and coose no and if so should I still complete an Affidavit of support for myself?

I am really apprehensive when it comes to the affidavit without unemployment...
