Employment letter ! Urgent !

Hi, thanks everyone.

The good news is my employer finally agreed to sponsor me and will file I-129 for me next week.
So who will sign the I-129? My employer or myself?

Thanks again,

Can I ask what status you are in now? You can't file for TN if you aren't currently in status. B2 is a valid status.

The I-129 is the employER's petition. THEY petition for you. Also, they will need to pay extra $1000 to allow you to start in next 2 weeks rather than 3-4 months.

Wouldn't it be more simple to get them to write a letter for you, and you go to border?

Based on the question you just asked, I anticipate you will coming back here with lots of questions on how to actually fill-in the I-129. save us, by actually readin the instructions first.

Glad that it worked out for you. Could you please let us know how your mail-in application goes? I believe your employer should sign the I-129. Are you going to get the premium processing?

I'm still on my 1-yr Tn which will be expired in this April. Hope those company attorneys who decided to sponsor me can handle the I-129 for me. I will definitely contact them to emphasize on the $1000 premium next week.

Why I chose mail over going to border because it seems much safer this way. I heard the Vermont centre rarely rejects any extension or employer changing. Hope that's very true.

The reason I never went from TN to GC was that I was never at an employer long enough to apply for one.

In addition to this, I didn't know about the TN to GC at the time of me applying for the H1-B and through a series of gaffs by my lawyer, the H1-B took three years to get (long story).

Now that the TN is good for three years, you should be able to get a GC without too many problems.

I just got an update from the HR manager. Clearly she was scared by "TN sponsorship". She told me they've already had a few meetings with legal person but couldn't come up with anything. And she told me if they were unable to sponsor me they have to continue searching.

DO NOT USE...<ahem>, do not use the term "sponsorship"...that is synonymous with H1B/GC...use the word petition

Also, avoid saying "TN Visa"....say..."TN Status"

Repeat after me..."since I will be going to get my personal goods in Canada, all I need is a letter addressed to the border officer to help clarify my legal working status here in the US. This letter is refered to as a "petition for TN status" and I have already drafted a copy which you can review and sign, or even better, I can email it and you can print it on company letterhead to give it some official oooomp"

BTW, Feel free to add that a lot of Americans work in Canada under the "TN status" :D...that may help put H/R @ ease...I learnt that a little B/S with H/R people works wonders...
