Employment denied... Why???

Hello everyone.

I was granted asylum in May 2005. I applied and receied my EAD back then but never worried about renewing it and never had any trouble getting employed.

The SSA web page "Types Of Social Security Cards" (www_ssa_gov/ssnumber/cards_htm) clearly demonstrates that if your Social Security card shows only your name and SS number; you are have been "lawfully admitted to the United States on a permanent basis."

Being unemployed for over two years, I have received unemployment, food stamps and other benefits, without any problems BUT ...

I recently applied for a job at Papa John's and after being selected, they denied me the job.

Among the documents they requested, they wanted to see my I-94, which is stamped with the "Asylum Approved" seal and my Social Security card which DOES NOT have any employment restriction on it. Both documents were shown to them in ORIGINAL.

The reasons they gave for not accepting me were:
  1. "There is no expiration date on your I-94, that is not normal" and,
  2. "Your Social Security card shows a date on it, that is not normal"

I can only guess they implied my I-94 and SS card are fake!!!

My questions are:
  • Are these people right in denying me employment based on what they said? and,
    [*]What can I do?
    [*]

Please advice. Any and all comments on this issue are greatly appreciated.

Your employment has been denied unfairly. Please print the page 10 of this document "Handbook for Employers" and show it to your employer.

"After being granted asylum in the United States, the asylee will receive a Form I-94/I-94A with a stamp or notation indicating asylee status, such as “asylum granted indefinitely” or the appropriate provision of law (8 CFR 274a.12(a)(5) or INA 208). This document is considered a List C document that demonstrates employment authorization in the United States and does not expire. If the asylee chooses to present this document, he or she also will need to present a List B identity document, such as a State-issued driver’s license or identification card."

You are considered "an alien authorized to work", not "permanent resident".
 
You can report this employer to the Office of Special Counsel for Immigration-Related Unfair Employment Practices by calling 1-800-255-7688. You can also visit this link to file a charge

You are an asylee and you do have the right to work in the US if you have unrestricted SS card and valid driver license.


The Office of Special Counsel for Immigration-Related Unfair Employment Practices (OSC) enforces the anti-discrimination provision (§ 274B) of the Immigration and Nationality Act (INA), 8 U.S.C. § 1324b.

This federal law prohibits: 1) citizenship status discrimination in hiring, firing, or recruitment or referral for a fee, 2) national origin discrimination in hiring, firing, or recruitment or referral for a fee, 3) document abuse (unfair documentary practices during the employment eligibility verification, Form I-9, process, and 4) retaliation or intimidation.

File an I-912 Fee Waiver Request along with your I-485, I-131, and I-765 and request waiver of the biometrics fee also. YOU are readily eligible for a Full Fee Waiver.

As for the employer...I did not see your documents so I cannot say if they were wrong or right, BUT you did not say what valid government issued ID you presented.

You should have been a citizen or a GC holder at least by now. This economy needs people who can work. You can not be approved an asylum and u decide to leave on unemployment, food stamps and other benefits. You need to work and pay tax in order to be thankful to the US gov't for granting you asylum which saved ur life. Some of us which we had this employment authorization...well, i hope u get a job soon and change or adjust ur status...

nimbiotics needs useful information here regarding his employment eligibility. He doesn't need a lecture. You don't even have EAD yet and you are already giving asylees lectures on how to live their lives in the USA.
