I just got approved for my EB1 I-140 and applied for I-485. However, I did not include any I-864 or tax forms for my spouse who is applying on a
derivative status. My questions are:

1) Do you think I am required by law to file for I-864, and does my spouse or myself get an RFE for this?

2) If so, could you tell me whether we could still file I-864 now and what the procedures are for such delayed filing?

Any missing documents can be filed

after you receive the receipt numbers. However for an employment based derivative Affidavit of support is not mandatory.

My friend, who has a similar situation and filing status, is getting on my case for not having included 864, prior years\' tax returns, etc. etc. Hence the need for the clarification.
 
You don\'t have to include those documents.

But most people do include them with their I485 application. FYI, I didn\'t include the affidavit of support.
