Employment Authorization Question - Please share your thoughts

I start a new job on Oct. 31. I have a restricted social security card, and I mailed my valid I-94 to CIS with other documents they requested in the RFE. My new employer wants evidence my of employment authorization. I went to the social security office to get un-restricted social security card. They asked for my valid I-94, which I did not have with me.

My case has been transferred to the local office. I have mad InfoPass appointment with the local office, hoping that they will pull out my I-94 from my file will and give it to me.

Questions: If go there, will they give my I-94? Has anyone had similar experience? Your suggestions will be highly appreciated.

Just Tell Your Boss To Call Uscis

You can call USCIS at their general info line and tell them that your employer needs to verify your immigration status, they have number for employers they should give it to you , than go to your boss give him the phone number and tell gim to get off his lazy ass and call them because he should already have their number and was supposed to call them when he first hired you.

Why did you wait so long to get a social security card? You could have received it as early as 2001. Do you still have the asylum grant letter? They might accept that.

thankful, I still have the original aslyum approval letter. I just don't have a valid I-94. I should have replaced my social security card long time ago, I just did not have the need to do so. Basically, I was lazy!

By LAW you are supposed to produce a document that shows your status. Employer is not liable to call ANYONE! You need to get papers in front of them to show you can work in this country.

Go to the local social security office and take your Asylum Grant letter. That should be enough for them to prove that you need an unrestricted SSN. When I get home, I will dig the SSA website memo that was posted here.

According to the SSA website, you must have an I-94 card or an EAD showing asylum status or an IJ order.

It appears that they will not accept grant letters. But there is no harm in trying. They should be able to verify your asylum status online in real time.

I went to the local social security office, they told me that they need the original asylum approval letter (which I had with me) and a valid I-94 (which I did not have). I am going to the local CIS office, where my applicaiton is currently pending, to ask them to give me my I-94 or any other document that will be acceptable to the SS office. I hope they will help me out.

I tried, they said they can't do it with out and I-94. I just called the CIS 1 800 number, they told me that the local office should give me my I-94 back. I have mad an InfoPass appointment and hope they will help me out.

That sucks. The clerk in my SS office was satisfied with my EAD which has category A05 on it.

If they go by the books they can accept only three documents: I-94, an EAD with the A05 code or the immigration judge's decision.

If you have one of the three you are fine (as long as you are of normal intelligence).
 
Getting an unrestricted sociale security is not enough to proof you are authorized to work even if you are a US citizen.If you want to work for a 99 cents store,a sociale is good enough.But if you are applying for a real job,you need proof of work.In USA,lot of employers don't know much about asylum/refugee status.That's why they ask for green card , work authorization or proof of us citizenship .And asylum grant letter doesn't help in this case.That's why you read in asylum grant letter, they ask you to apply for work authorization card as proof of work....

you are wrong. The rules were changed a few years ago and the information in your asylum grant letter is out of date. Go to the asylum section of the USCIS website and it has the current information on asylee work eligibility. Asylees are treated as green card holders for this purpose. In other words they can obtain a normal social security card. All US citizens, green card holders and refugees/asylees can just show their ss cards plus a photo ID to their employers. It is sufficient. Unless this is a special or sensitive position, it is illegal for an employer to demand anything further. In fact, the Department of Justice has a special office which deals with this type of situation. All you need to do is to call them if you have a problem.
 
This is wrong. Just read the I-9 form.

Citizens, nationals, green card residents, refugees and asylees can use their social security cards and state IDs to demonstrate their work eligibility. Employer cannot ask for further proof of citzenship or immigration status. That would be illegal.
 
Thankful,Kiev,as what I said,this is right when you're applying for store or restaurant jobs.Cause what I do know,lot of illegal people in USA have unrestricted social and state IDs.Employers know about this.Tell me you did apply for city jobs or any other educated jobs and they hired you just by showing a simple unrestricted social and state ID!
Go apply for a job in your nearest Bank,come back in this forum and tell me what did the manager asked for to get hired.

I worked for Mckinsey Consulting and Goldman Sach. In both cases I used my ss card and NY state ID.

Again it is illegal to demand more documents than the I-9 required, pure and simple.

Cadel, I work for the USPS, a Government entity. I showed my SSN Card & my drivers license when Iwas hired. I had to go through a Sensitive Postal Clerance also(Unrestricted unemployment ability required + 8 Years in this country)...I had no problem. I am sure U.S Government would've made a big deal if it wasnt right..

Usualy the small employers ask for more requirements than the bigger companies..Smaller employers don't have the ability to check your SSN with the USCIS database.like big employers do...

Cadel, I have received an offer for a very high level position from a top investment banks in the country (not from a store or restaurant) and that's why I am so careful with my employment authorization documents. As long as I have un-restricted SS card and a valid driver's lincense, I should be fine. I need to get my I-94 from the local office to get the un-restricted SS card.

Wantmygcnow,What I do know is,to work for Post office,you need to be a us citizen or a PR.I'm so surprised the USPS hires you just by showing an unrestricted SS card and ID.I have an unrestricted SS card since the grant of my asylum in 2000.In 2003,I passed a test for New York Police Department(NYPD) as a Traffic Enforcement Agent.Since I had no GC,my job was pending.When I received my GC on Sep 20 ,2005,I called my investigating officer, forwarded my Gc and then they finally hired me Oct 10,2005.So,to be a police officer,I need to be a US citizen,This how it works.The only unrestricted sociale didn't work.Good job = Social security card+ state ID +Proof of citizenship.
