Hi,
I have been working with my current employer (H1) for the past 4 months and he has not been paying me (in spite of me being on the project) for last 3.5 months.I do not have even single paystub from the employer.
He says he will generate pays stubs once he recevies payment from middle vendor.His payments terms are such that he recevies payment after 60 days.He is also creating lot of other problems and mentally harrassing me.
Now he says he is not interested in working with me and would like to cancel my H1
I have talked to another employer who is ready to transfer my H1.But i need paystubs from my existing employer
I want to know what are my legal rights and how should I proceed to get my payment and current paystubs from this employer.(I have the employment letter from him stating xxxxxx per annum will be paid to me).
PLEASE ADVISE ME URGENTLY. Any help would be greatly appreciated.
